Licensing Program Analyst (LPA), Keyona Scott, conducted an unannounced inspection to the family childcare home, on 11/12/2021, for the purpose of delivering findings to complaint investigation # 30-CC-20210920144237. LPA met with Licensee, Kenishia Colby-Martin, at 1:48 PM. Only Licensee was present during the inspection; no children were in care. Per Licensee, childcare is closed for the day. LPA did not observe any children in care.

It was alleged that an uncleared adult is present and residing in the home as well as smoking around children in care, and the provider is impaired during operation hours. Based on investigation and facility observation, there were no disclosures made or observations viewed; therefore, the allegation of CRIMINAL RECORD CLEARANCE, uncleared adult in the home spends time around the children, PERSONAL RIGHTS, the provider is impaired after drinking alcohol around the children and PERSONAL RIGHTS, an adult in the home smokes in front of the children, are UNSUBSTANTIATED, meaning although the allegations may have happened or are valid, the preponderance of the evidence standard has not been met.

No deficiencies were cited during today’s inspection on 11/12/2021.

The following was discussed with Licensee:

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A notice of site visit was given and must remain posted for 30 days.
