On 7/10/24, Licensing Program Analysts (LPAs) Jeanine Lipsey, Amelia Morales and LPM Emiko Bell conducted an unannounced Annual Required-3 Year Inspection. Upon arrival, LPM and LPAs were greeted and let into the facility by Licensee Shila Saruri.

As Licensee Saruri guided LPM and LPAs on a tour of the residence, 16 children were observed to be in care. As licensee is licensed for a capacity of 14,Licensee was over capacity from 2:10pm to 3:04pm. When licensee was notified that she was overcapacity, she agreed to phone two parents to pick up their children in order to come into compliance. At 02:48 pm, a one year old was picked up; at 03:04, a one and a 4 year old were picked up and the facility was in compliance.

Licensee's days and hours of operation are Monday through Friday 8am to 5:30pm.

The following required postings were observed on the Parent Board, which is a cork board which is kept the outside of the back door to bedroom #2, which is were the daycare children are dropped off in the morning: the license, the LIC610A Emergency Disaster Plan, and LIC 9148 Earthquake Preparedness Checklist; PUB 394 the Notification of Parents’ Rights Poster was not posted. LPA advised that all LIC9213 Notice of Site Visits shall be posted for 30 days after each site visit. LPA advised that any licensing report documenting a Type A citation must be posted for 30 days.

Licensee stated that though she has been running disaster drills, she has not been keeping a log of the dates and time of the drills.

All areas of the residence were inspected except for the second floor, which is off-limits. The staircase leading upstairs is rendered inaccessible by a baby gate placed at the bottom of the stairs. There are two bedrooms and one bathroom upstairs. This is a 2 story, 5-bedroom, 3 bathroom home with living room, kitchen and detached garage. Bedrooms #1 and #2, 1 bathroom, and the backyard are used for childcare.

LPA did not observe any poisons present during the inspection. Detergents, cleaning compounds, medication and other hazardous item were rendered inaccessible to children. Per applicant, there are no firearms or weapons on the premises. There was no body of water observed on the premises. LPA observed the home to be free from defects or conditions which may endanger the children.

There is a fire place in the living room, which is used for toy storage. The second fireplace, located in the backyard, was not rendered inaccessible.

There was a fully stocked first aid kit, kept in bedroom #1. There is a carbon monoxide detector in the kitchen, which was tested and is operable. Smoke detectors are located in the dining room, bedroom #1and hall way' all were tested and are operable. There is a fire extinguisher, size 3A40BC, mounted in the kitchen and was last serviced on 10/17/19; it needs to be serviced. Electrical outlets were observed to be inaccessible to children in care with the use of plug covers. The home was observed to be clean and orderly with heating and ventilation. LPA observed safe toys, play equipment, and materials. The outdoor area was fenced and free from hazards. Licensee ensures that children in care are always supervised.

As evidenced by record review, Licensee and her two assistants do not have proof of Mandated reporter or current First aid/CPR training, as the card shown was expired.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. On this date, 7/10/24, the California Attorney General - Megan's Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA's discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and­resources/safe sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

Based on LPA's observations, the following deficiencies listed on the attached LIC809D (deficiency page) are being cited in accordance with Title 22, Division 12, Chapter 3, of the California Code of Regulations. Deficiencies that are being cited need to be cleared to protect the children's health & safety.

Exit interview conducted and report was reviewed with Licensee Shila Saruri.

A notice of site visit was given and must remain posted for 30 days.
