On 02/06/2020, Licensing Program Analyst (LPA) Miriam Cohen made an unannounced visit and met with Nicole Thompson, preschool director, for the purpose of conducting an investigation regarding the Unusual Incident/Injury Report that took place on 01/24/2020 at A Bright Beginning, Inc. Infant Center located at 503 S. Praire Avenue, Inglewood, CA 90301. The facility did not contact the Regional Office within 24 hours after the incident; however, a written report was submitted on 01/28/2020.
Upon arrival, LPA observed seven adults providing care and supervision to 25 children. All center staff that was present during today’s inspection had fingerprint cleared and associated to the designated license number.

During today’s inspection, the director and LPA toured the playground where the incident occurred. LPA Cohen obtained copies of the following: Children’s Roster, Teacher’s attendance, Ouch Report, Emergency ID for the child involved, Action Plan and Procedure for playground usage.
Written declarative were obtained from the following: Three teachers, one director, and parent of the victim child.

The Infant center shall be cited a Type A violation for each of the following according to:
* S&H1596.956(4) Child day care centers serving infants; optional toddler program; departmental guidelines and regulations
(4) A ratio of six children to each teacher shall be maintained for all children in attendance at the toddler program. An aide who is participating in on-the-job training may be substituted for a teacher when directly supervised by a fully qualified teacher. This standard was not met as evidenced by one staff member supervising 12 toddlers while in the playground.

A civil Penalty Assessment – Immediate for Type A deficiency above shall be assessed today

All personnel shall be given on-the-job training in the areas listed below, or shall have related
experience that demonstrates knowledge of and skill in those areas. Such training or
experience shall be appropriate to the job assigned and shall be evidenced by safe and
effective job performance.
This standard was not met as evidenced by the following statements provided by S2:
She went back inside to attend to two children that were under her care.
Inside the classroom the following was observed:
*Staff #3 was attending to the children that were using the restroom
*Staff #4 was attending to the children that were washing their hands
*Staff #5 was cleaning the tables after a birthday party concluded

* 101223(a)(3) Personal Rights
(a) The licensee shall ensure that each child is accorded the following personal rights:
(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.
This standard was not met as evidenced by the child breaking two wrist bones and sustaining a cast after falling four feet high from the climbing apparatus located in the playground.
The director was instructed to provide enrolled and newly enrolled parents (for the next 12 months) with a copy of the report along with LIC 9224 (Acknowledgement of receipt of Licensing Reports. The above Infant Center will also receive an Immediate Civil Penalty Assessment Required for violation of Infant Ratio.

The Infant center shall be cited a Type B violation for the following:

(d) Upon the occurrence, during the operation of the childcare center of any of the events
specified in (d)(1) below, a report shall be made to the Department by telephone or fax within
the Department's next working day and during its normal business hours. In addition, a written
report containing the information specified in (d)(2) below shall be submitted to the Department
within seven days following the occurrence of such event.
(1) Events reported shall include the following:
(B) Any injury to any child that requires medical treatment.
This standard was not met as evidenced by director admitting to LPA that she was not aware about the above regulation (contacting the Regional Office within 24 hours after the incident)

After visual observation of the physical plant, conducting interviews, record and video reviews, and consultation with management, it appears that the incident above was a result of several California Code of Regulations Title 22 violations including Health and Safety Code.
The content of this report was read and discussed in detail at the time of with Nicole Thompson, Infant Center Director.

An exit interview was conducted; the notice of site visit must be posted for 30 days upon receipt.
