Prior to working or volunteering in a licensed childcare facility, all individuals subject to a criminal record review have received a criminal record clearance or exemption. Upon notification from the Department, the licensee will comply and act immediately to terminate the employment of, remove from the facility or bar from entering the facility for any person it is deemed necessary while the Department considers granting or denying an exemption.
LPA reviewed 5 staff files and observed 4 files did not have current Mandated Reporter Provider Training certificate for LPA’s review. LPA issued a technical violation. At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. LPA provided director with the list of approved EMSA approved vendors to use as a resource when planning future training.
LPA reviewed a sample of children’s files, 8 files, and observed files were complete. LPA provided facility with a copy of the LIC 311A and LIC 125 to use as a reference to ensure all files have current documents.
The name of the child care center director or fully-qualified teacher(s) designated to act in the director’s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. LPA observed sign in and out sheets outside the preschool classrooms.
All children are under supervision, including visual supervision, of a teacher at all times. Facility maintains a ratio of one teacher supervising no more than 12 children in care.

Facility representative, Marissa Fuentes was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
Incidental Medical Services (IMS) currently IS being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. LPA and facility admin discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
