Licensing Program Analyst (LPA) Sophia Lord-Richard met with Lisa Garcia, Director for the purpose of an Annual/Random Inspection. LPA Lord-Richard toured the facility at 8:25 AM, all identified rooms per facility sketch was inspected, the following was observed. Pre- school hours are from 6:30 AM to 6:00 PM, Monday through Friday.

Upon arriving at the preschool LPA observed 14 children being supervised by 2 adults. LPA observed sign in /sign out sheets. Facility is operating within capacity limitations. LPA observed 4 classrooms on the property. LPA observed classrooms 1 and 2 used for Preschool and classrooms 3 and 4 used for Toddler Option. A walk through of each classroom was conducted, classrooms were found to be clean and free from any potential hazards. LPA observed classrooms to have dramatic play, arts/crafts, reading and learning activities. LPA observed an open air area between classrooms for activities and crafts. Preschool children utilize the activity space during the school day.

Furniture was found to be in good repair and age appropriate. There is adequate heating, lighting and ventilation. Drinking water is readily available in each classroom. Director states that the isolation area for sick students is located in the Director's office on a cot or mat. Napping equipment and bedding was inspected for good condition, appropriate storage and cleanliness. Preschool children nap in the classroom.

The bathroom area(s) were inspected, each classroom is equipped with a bathroom, there are sufficient toilets and sinks to accommodate the campus capacity. Toilets flush properly, toilet and sinks are reachable by the children in care. Each rest-room has adequate Toilet paper and paper towels available. Bathrooms were found to be clean. There is adequate lighting/ventilation in the bathroom area(s)

Lunches and snacks are prepared by the school, Parents can bring Lunches for their children. Cleaning supplies are out of reach to the children and is stored separately.

Inspection of the outdoor play area was conducted climbing structures, slides and other large play equipment is found to be securely anchored with adequate resilient cushioning material underneath and around the perimeter. Drinking water is readily available on the play yard. There is adequate shade for the children in care. Fencing around the perimeter of the play area is at least 4 feet high. Playground is free from miscellaneous debris such as tree branches, trash, leaves, etc.

Medication is properly labeled and stored in the original container. First Aid supplies are stored in each classroom and in the Director's office. All medication is stored in Directors office.

Children and staff records were reviewed for completeness records were found to be complete.
Director advised that records for all children and staff must be maintained for 3 years after separation from the facility. A record of teachers/assistants names was check against current facility roster, Staff are currently associated to the campus in which they are assigned to work. LPA observed CPR/First Aid card for Director Lisa Garcia that expires 05/18/2021.

The following was discussed with the Director:
Mandatory Forms for the children’s files and provider’s files, Requirements for fire drills, earthquake drills and documentation for both. Role and responsibilities of being a mandated reporter were discussed. The licensee was advised how to access forms and Regulations for Family Child Care online at www.ccld.ca.gov . Licensee was made aware that it is their responsibility to know the regulations as well as anyone who assists in providing care. Licensee was advised on how to access quarterly reports, forms, and regulations for Child Care online at www.ccld.ca.gov. The licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care. Licensing must have the facility’s phone number at all times; if the phone number is changed, licensing must be notified. Regulation prohibits the smoking of tobacco on the premises.

The licensee was informed of The Child Care Advocate Program (CCAP) that is administered from within the Community Care Licensing Division. CCAP participates in many community activities and special projects in order to disseminate information on the State’s licensing role, provide information to the public and parents on child care licensing, and provide many other helpful resources to the licensees and the public. LPA also explained Assembly Bill 1207 California Child Care Workers; Mandated Training Requirement. Beginning January 1, 2018, all licensed providers, applicants, directors and employees must complete Mandated Reported Training prior to March 30, 2018 and renew training every two years at: www.mandatedreporterca.com.

Senate Bill 792: this bill, commencing September 1, 2016, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles.



New Immunization Requirement: Law enacted by SB 277, beginning January 1, 2016, personal beliefs exemptions will no longer be an option for the vaccines that are currently required for entry into child care or school in California. Personal beliefs exemptions already on file will remain valid until the child reaches the next immunization checkpoint.

New Appeal Process: A licensee may file an appeal, in writing 15 business days from the date of receiving the penalty assessment.

Nutrition Requirement: Beginning January 1, 2016, AB 290 will require for each new license issued, at least one director or teacher at each child care center or family child care home to have at least one hour of training in the importance of childhood nutrition. This applies to anyone submitting a new application, relocating their facility, selling their facility or transferring their license. Please note this training cannot be completed online or by home study programs. The training must be taken from an Emergency Medical Services Authority (EMSA) approved training program OR an accredited college or university.

Update on Incidental Medical Services: Facilities that provide Incidental Medical Services (IMS) must identify those services in their facility’s Plan of Operation and submit an updated Plan of Operation to the Department. Incidental Medical Services Include: Blood-Glucose Monitoring for Diabetic Children, Administering Inhaled Medication, Administering EpiPen Jr. and EpiPen or other Epinephrine Auto-Injectors, Glucagon Administration, Gastrostomy Tube Care (G-tube care), Insulin Injections Administration, Anti-Seizure Administration, and Emptying an Ileostomy Bag.

This facility does not provide Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. State law prohibits baby walkers, bouncy seats, exer-saucers and any other items that fall into that category. All infants must be placed on their backs when sleeping to prevent S.I.D.S. (Sudden Infant Death Syndrome), and that the Provider is required to wash hands after every diaper change and to never shake a baby to prevent the Shaken Baby Syndrome. Only children eating may be in high chairs and that car seats are utilized only for transportation.

The ADA requires that child care providers not discriminate against persons with disabilities on the basis of disability, that is, that they provide children and parents with disabilities with an equal opportunity to participate in the child care center's programs and services.

Requirements for fingerprint clearances and associations were discussed with the licensee. Licensee can be cited a civil penalty of $100 per day, up to $500.00 (5 days) for the 1st offense and up to $3000.00 for the 2nd offense within a 12 month period. The licensee was advised of the requirement to report unusual incidents and/or injuries to the parent/guardian and licensing within the time frame specified by the regulation. The "Notification of Parent's Rights" (PUB394) poster must be posted in an area accessible to parents. The information regarding new legislation with regards to exemptions and Parent’s Rights was also discussed.

The licensee was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. If a serious violation is cited, a copy of the licensing report (LIC809 or LIC9099) must also be posted for 30 days. If these requirements are not met, civil penalties in the amount of $100 per violation will be assessed. Copies of the reports must also be provided to each parent when a serious deficiency, Type A, is cited (LIC9224).
An appeal may be filed, in writing 15 business days from the date of receiving the penalty assessment. As of September 1, 2016, SB 792, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles. LPA discussed the influenza waiver during the visit.
