Due to COVID-19 investigation restrictions, this report is being delivered by Tele-inspection.
On 05/01/2020, Licensing Program Analyst (LPA) Jeanette Estrada conducted a subsequent complaint investigation visit to the Ramos Family Child Care to deliver the findings and conclude the investigation into the following allegation that was received on 1/27/2020: Child in care was sexually abused. LPA met with the Licensee, Luz Ramos and informed Licensee of the reason for the visit. This tele-visit was conducted in Spanish and the report was verbally translated. The Licensee is a monolingual Spanish speaker therefore interviews and visits with the Licensee were conducted in Spanish.
During the initial complaint visit on 1/29/2020, LPAs Jeanette Estrada and Antonio Almanza toured the facility inside and out and obtained copies of LIC 9040(Facility Roster), Mandated Reporter Training Certificate and LIC 9163 (Request for Live Scan Service) for Staff 1 and the Applicant Fingerprint Response for Staff 2.

PG.2 It is alleged that a child has been sexually abused by an adult while in care at the Ramos FCCH. The allegation stemmed from an observation of a behavior and an alleged verbal disclosure. The observation that was reported indicated that Child 1 appeared to be touching Child 2 on the buttocks with an object. The witness questioned Child 1 about the observation, which stemmed the allegation.

On 2/13/2020 LPA Estrada conducted a pre-investigation interview to gather additional details. During this interview, LPA Estrada was told that Child 1 allegedly disclosed that they have access and go into a bedroom in the family child care home (FCCH) with one of the adults in the home. However, on 2/21/2020 LPAs Estrada and LPA Claudia Escobedo inquired with the Licensee Luz Ramos, about accessibility to the bedrooms in the FCCH, according to the Licensee, the bedrooms in the FCCH are off limits. During this visit and the visit on 1/29/2020, LPA Estrada observed the doors of two of the bedrooms to be open. On the LIC 999A (Facility Sketch) the three bedrooms in the home are indicated as being off limits. The Licensee stated that the children in care do not really go into the bedrooms. This statement was corroborated by Staff 1 and Staff 2 who each stated during separate interviews conducted on 3/3/2020 and 3/10/2020, that the children did not go into the bedrooms. The Licensee and Staff 1 stated that the children occasionally peak into the rooms when they go to the restroom but there are no activities for them in the bedrooms since the day care activities take place in the living room. LPAs observed the living room to be set up as a day care with appropriate toys and furniture for the children enrolled (ages 1 year to 3 years). On 2/21/2020 LPA Estrada provided clarification to the Licensee on the department’s definition of inaccessibility regarding off-limit rooms. After discussion with the LPA, the Licensee agreed to keep the doors to the off-limit bedrooms closed and locked going forward.

LPAs asked the Licensee about the assistants that have worked at the FCCH. The Licensee stated that she has had 3 assistants. Staff 1 and Staff 2 had been present at the FCCH the few months prior to when the complaint was made, including the week it was reported. Per the Licensee, Staff 3 has not been present in the home for about a year. The Licensee stated that Staff 1 was hired to help her because Staff 2 was only working a couple of days a week and she needed help with Child 1 since Child 1 is older than the other children in care. The Licensee also stated that the duties of Staff 1 and Staff 2 were to assist her in supervising the children, assist in circle time and inform her if there were any concerns. Adult 2, who lives in the home, stated on 2/21/2020 that they have not witnessed any inappropriate behavior from the assistants towards the children. Continued on PG. 3- LIC 9099-C

On 3/10/2020 during an interview, Staff 1 stated that in the mornings while the Licensee was making breakfast, Staff 1 would just supervise the children. Staff 1 stated that after breakfast while the Licensee was tending to the younger children in care, Staff 1 and Child 1 would go to a separate area in the day care where they would practice the alphabet or numbers one on one. Based on LPA’s observation of the day care set up, the area described by Staff 1 is in the line-of-sight of anyone in the living room area. Staff 1 also stated that Child 1 would seek out Staff 1 so they could play together. LPA asked Staff 1 if they were ever left alone with any of the children and Staff 1 answered, “No”. Staff 2 also stated that their duty assignment was to assist in supervising children and with activities.
In investigating this complaint, there were no findings to support that the allegation of sexual abuse occurred. According to other agency investigations and examinations, Child 1 did not repeat the alleged disclosures initially made, and there is no physical evidence of the alleged sexual abuse.

Based on LPA’s observations, interviews and record reviews gathered during the investigation, the allegation investigated above was found to be Unsubstantiated. A finding that the complaint is unsubstantiated means although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation occurred.

An exit interview was conducted via Tele-Visit with the Licensee, Luz Ramos in which this report was read to her and translated into Spanish. A copy of this report and a Notice of Site Visit were issued to the Licensee. A copy of this report is being emailed to the Licensee and it has been explained that a reply to the email shall be considered a substitute for the hard-copy signature.

Debido a las restricciones de investigación de COVID-19, este informe está siendo entregado por video llamada.

El 05/01/2020, Analista del Programa de Licencia (Licensing Program Analyst (LPA)) Jeanette Estrada esta haciendo una visita a Ramos Family Child Care para entregar los hallazgos y para concluir la investigación en la acusacion que fue recibida el 1/27/2020: La acusacion fue -Child in care was sexually abused (un nino a cargo fue abusado sexualmente.) LPA se reunion con la proveedora, Luz Ramos y le explico la razon por la video llamada. Esta video llamada fue realizada en Español y el informe fue traducido verbal mente. La proveedora habla mayor mente Español por lo que las entrevistas con la proveedora se llevaron a cabo en Español.

Durante la primera visita el 1/29/2020 LPAs Jeanette Estrada y Antonio Almanza revisaron la guarderia por dentro y por afuera y obtenieron copias de LIC 9040(Facility Roster), Mandated Reporter Training Certificate y LIC 9163 (Request for Live Scan Service) para empleado 1 y the Applicant Fingerprint Response para empleado 2.

Se alega que un niño ha sido abusado sexualmente por un adulto mientras estába en el cuidado de Ramos FCCH. La acusación se derivó de la observación de un comportamiento y una supuesta divulgación verbal. La observación que se informó indicó que el niño 1 parecía estar tocando el niño 2 en el posterior con un objeto. El testigo le pregunto al Niño 1 sobre la observación, y de ayi derivó la acusación.

El 2/13/2020 LPA Estrada llevó a cabo una entrevista previa a la investigación para reunir detalles adicionales. Durante esta entrevista, LPA Estrada fue informada de que el niño 1 supuestamente reveló que tiene acceso y dentra a una recamara en la casa con uno de los adultos en el hogar. Sin embargo, el 2/21/2020 LPA Estrada y LPA Claudia Escobedo preguntaron con la proveedora Luz Ramos, sobre la accesibilidad a las recamaras en la casa, según la proveedora, las recamaras en la casa están fuera de los límites. Durante esta visita y la visita de 1/29/2020 LPA Estrada observo que las puertas de dos de las recamaras estaban abiertas. En la forma LIC 999A (Dibujo del Establecimiento) las tres recamaras se indican como fuera de los limites. La proveedora declaró que los niños a cargo realmente no se meten a las recamaras.

Esta declaración fue corroborada por empleado 1 y empleado 2, quienes declararon cada uno durante entrevistas separadas realizadas el 3/3/2020 y 3/10/2020, que los niños no entraban en las recamaras. La proveedora y empleado 1 declararon que los niños ocasionalmente alcanzan las habitaciones cuando van al baño, pero no hay actividades para ellos adentro de las recamaras ya que las actividades de guardería tienen lugar en la sala de estar. Las Analistas observaron la sala para ser establecida como una guardería con juguetes y muebles apropiados para los niños inscritos (de 1 año a 3 años). El 2/21/2020 LPA Estrada aclaró al la proveedora la definición de inaccesibilidad del Departamento con respecto a las recamaras fuera de los límites. Después de la conversacion con LPA, la proveedora acordó mantener las puertas de las recamaras fuera de límite cerradas y bloqueadas en el futuro.

LPAs preguntaron al la proveedora sobre los asistentes que han trabajado en la guarderia. La proveedora dijo que ha tenido 3 asistentes. Empleado 1 y empleado 2 habían estado presentes en la guarderia los pocos meses anteriores a la fecha en que se presentó la queja, incluyendo la semana en que fue reportado. Según la proveedora empleado 3 no ha estado presente en el hogar durante aproximadamente un año. La proveedora declaró que empleado 1 fue contratado para ayudarle porque empleado 2 solo estaba trabajando un par de días a la semana y necesitaba ayuda con el niño 1 ya que el niño 1 es mayor que los otros niños en cuidado. La proveedora tambien dijo que las funciones de empleado 1 y el empleado 2 eran ayudarle a supervisar a los niños, ayudar en el tiempo del círculo e informarle si habían algunas preocupaciónes. Adulto 2, que vive en el hogar, declaró el 2/21/2020 que no ha sido testigo de ningún comportamiento inapropiado de los asistentes hacia los niños.

El 03/10/2020, durante una intrevista, empleado 1 dijo que en las mañana cuando la proveedora estaba cocinando el desayuno empleado 1 no mas supervisaba a los ninos. Empleado 1 dijo que despues del desayuno mientras la proveedora atendía a los niños más pequeños a cargo, empleado 1 y el niño 1 iban a un área separada en la guardería donde practicaban el alfabeto o los números un poco separados. Basado en la observación de LPA Estrada de la guardería en el hogar, el área descrita por empleado 1 está en la línea de visión de cualquier persona en el área de la sala. Empleado 1 también declaró que niño 1 buscaba a empleado 1 para que pudieran jugar juntos. LPA Estrada le pregunto a empleado 1 si alguna vez se a quedado solo con alguno de los niños y empleado 1 respondió: "No". Empleado 2 también declaró que su deber era ayudar a supervisar a los niños y a las actividades.

Al investigar esta denuncia, no hubo constataciones que respaldaran que se produjo la denuncia de abuso sexual. Según otras investigaciones y exámenes de otras agencias, el Niño 1 no repitió las supuestas divulgaciones hechas inicialmente, y no hay evidencia física del presunto abuso sexual

Sobre la base de las observaciones de LPA, entrevistas y revisiones de registros reunidos durante la investigación, se encontró que la acusación investigada anteriormente no estaba fundamentada. La constatación de que la denuncia no está justificada significa que, aunque la denuncia puede haber ocurrido o es válida, no hay preponderancia de pruebas que demuestren que se produjo la presunta violación.

Se llevó a cabo una entrevista de salida a través de video llamada con la proveedora , Luz Ramos en la que se le leyó este informe y se tradujo a español. Se emitió una copia de este informe y un Aviso de Visita al Sitio a la proveedora. Se está enviando una copia de este informe por correo electrónico al la proveedora y se ha explicado que una respuesta al correo electrónico se considerará un sustituto de la firma impresa.
