On10/2/2019 LPA Chandler made an unannounced visit to the Learning Garden Infant center for the purpose of delivering findings for the above allegations.

Statements from witness disclosed that children are occasionally allowed to temporarily sleep in their car seat for short periods of time.
LPA has evaluated and weighed all of the evidence provided. Based on the interviews and observations there is a preponderance of the evidence, therefore the allegations are substantiated. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met.

Statements from witness and LPA observation during a visit on 5/22/19 disclosed that microwave heating was used to heat infant's bottles, such heating does not follow the directions for preparing/heating formula and can result in serious burns according to the label. This violates Title 22 regulation and poses an immediate risk to children in care.

Based on the above there is probable cause to conclude that the incident possibly could have happened, however there was not enough evidence to support the allegation. Therefore the allegation was found to be unsubstantiated. A finding that the complaint is “unsubstantiated” means that although the allegation could have happened or could (possibly) be valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.”

The licensee was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. If facility was cited type A violations or complaint is found to be substantiated or unsubstantiated, a copy of the licensing report (LIC809 or LIC9099) must also be posted for 30 days. If these requirements are not met, civil penalties in the amount of $100 per violation will be assessed. Licensee must inform the parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months via form LIC-9224 Acknowledgement of Receipt of Licensing Reports.

Signed copies of the LIC - 9224 shall be mailed or faxed to LPA no later that 10/1/2019.

An exit interview was conducted, a copy of this report was provided along with the appeal rights.
