On 04/27/23 at 9:25 AM, Antonio Almanza, Licensing Program Analysts (LPA), conducted an unannounced complaint investigation. LPA met with Aviance Kelly, Assistant. LPA explained the purpose of the site visit and was guided on a tour of the home inside and out. During today’s visit there are 12 children and 4 staff providing care and supervision. During todays visit Licensee was at doctor’s appointment.

During today’s visit, LPA made observations, reviewed records and received a copy of facility roster. LPA observed 5 infant children in care. Infants 1 – 3 where observed in the infant room and Infants 4-5, who are able to walk, where observed in the child care room. Staff 3 is reporting that they do not consider the two children that are walking, infants. LPA and Staff 3 verified the age of Infants 1-5 and all 5 infants are under the age of 2 years old.

During today visit the facility is out of ratio with 5 infants in care. Based on LPAs observation and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED. California code of Regulations, Title 22, Division 12 & Chapter 1, are being cited on the attached LIC9099D.

The following Type A deficiencies is being cited during today's inspection (see LIC 9099D). Each report (documenting a Type A citation) shall remain posted for 30 days along with the Notice of Site Visit. In addition, A copy of this report must be provided to the authorized representatives of all currently enrolled children and any newly enrolled child for the following 12 months. The ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC9224) shall be signed and kept in each of the children’s records. The report shall be provided no later than the next business day or the next day the child is in care.


1. 102416.5 Staffing Ratio and Capacity (d) For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either: (1) Twelve children, no more than four of whom may be infants; or


Based on LPAs observation and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.
