13 | Licensing Program Analyst's (LPA's) Smith and Thompson-Miller conducted an unannounced complaint inspection to deliver investigation findings for the aforementioned allegations. LPA's met with Director Diane Stein. During the inspection, there were no children in care. Allegation #1: Based on LPA Ramirez observations and LPA's Smith and Ramirez interviews conducted with staff and parents, the allegation is deemed unsubstantiated. There is not a preponderance of evidence that staff restrained a child. Allegation #2: Based on LPA Ramirez observations and LPA's Smith and Ramirez interviews conducted with staff and parents, the allegation is deemed unsubstantiated. There is not a preponderance of evidence that staff isolates a child/children while in care. Allegation #3: Based on LPA Ramirez and LPA Smith interviews conducted with staff and parents, the facility was not required to report an outbreak of an epidemic (contagious viral infection) due to only one child in care contracting the infection. Therefore, the allegation is rendered Unsubstantiated at this time. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegations occurred. Exit interview conducted and a copy of this report was explained and provided to Director, Diane Stein. A notice of site visit was provided and must be posted for 30 days. |
