Licensing Program Analyst (LPA) Alicia Mooberry conducted a Required Annual Inspection on this date. Upon arrival at 1:00pm LPA met with Rachel Shalom, who provided tour of facility. LPA explained the purpose of inspection and provided the inspection Entrance Checklist, LIC 126.

LPA inspected rooms/areas on the facility sketch in which child-care services are provided and to which children have access. Per licensee the hours of operation are Monday-Friday 8:00am- 5:00pm. LPA observed volunteer Cynthia Olivares. LPA observed 13 children present including 4 infants, facility is over the capacity limitations. LPA observed 11 children napping in the converted garage supervised by Maria Sanchez, Assistant staff. The licensee confirmed that the garage does not have a certificate of occupancy, this poses an immediate risk for the health and safety of children in care.

This is a one story 3 bedroom, 2 bathroom home with a detached garage in the back yard that has been converted to a playroom. All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. The following was observed and reviewed during this inspection: According to the facility sketch, the living room and dining room are the daycare areas and children use the bathroom in hallway.

LPA advised licensee to ensure the living room and bathroom used by children are free from hazardous items. Per licensee, the children will no longer nap, eat or use the bathroom in the garage/playroom unless she has the required building permits.

LPA observed the required formed posted in prominent location visible to parent/guardians of children in care. LPA reviewed completed facility records including LIC 9040- Facility Roster, LIC 610- Facility Disaster Plan.


Staff and Children’s records were reviewed and found complete.

Smoke and carbon monoxide detectors were tested and are operable. Fire extinguisher indicated fully charged and was serviced on 02/2023. The home maintains telephone service via cell phone line. The home is observed to be clean and orderly. LPA observed that cleaning compounds are in kitchen inaccessible to children in care.

Licensee states that there are no poisons stored in the home and understands that all poisons must be lock, not only inaccessible to children. Per Licensee there are no firearms or weapons stored in the home.

Children that are ill are separated from other children in the living room while they waiting to be picked up.

There are 4 infants currently enrolled in the daycare. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Currently, children are using the back yard for outdoor play. LPA observed that the outdoor yard is fenced and has toys and other materials for children. The facility does not have a pool or similar bodies of water. Per licensee, there are not pets in the home.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. -------------Page 2 – Report Continues

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Based on the LPA's observations and records review the following deficiencies will be cited today in accordance with California Title 22 Regulations.

A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee.

During the exit interview, the Licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

A notice of site visit was given and must remain posted for 30 days.
