Licensing Program Analyst (LPA), V. Wheatley conducted an inspection regarding the above allegations. LPA met with the director Dyan Reilly at 11:15am. The director denies the allegations and state there is an unwritten no cellphone policy and that teachers are not allowed to be on their phones while supervising children. The director states she is on the premises from 7:45am to 4:30PM on Mondays and Tuesday. On Wednesday and Thursday she is on the premises until 5PM and on Fridays she works until 2PM or 3PM. The director states that Teacher #2 is available to cover administrative or parental issues when she is not on the premises. LPA observed the director on the premises during each inspection.

LPA interviewed several staff members that denied being on their cellphones while supervising children. One staff member did mention that staff use their phones to take pictures in which they have permission from the parents. LPA interviewed Child #1, #2, #3 and #4. LPA observed the facility operating within proper ratios.

Based on the LPA's observations, interviews conducted the allegations are unsubstantiated, meaning although the allegation may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
