**This is an Amended Report created by LPA Ayala to add civil penalties associated with the uncleared adult at the facility on the last page of the report and assess penalties on LIC809D**

On November 21, 2023, Licensing Program Analysts (LPAs) Monique Ayala and Suzana Safaryan conducted an unannounced required 3-year inspection. A COVID-19 risk assessment was conducted prior to entering the facility. LPA met with Director, Deborah Mandel who guided the LPAs on a tour of the facility. This is a preschool age program that operate Monday to Friday 08:15AM to 3:45PM. Per director there are 80 children enrolled. LPAs observed 73 children in care. The facility is located in an Elementary/Middle School that utilizes classrooms on the first floor, a separated eating area and playground.

LPAs observed staff member Tatiana Arie who is not fingerprint cleared or associated to the facility. LPAs observed Tatiana providing care and supervision to children in classroom 100. LPAs verified on Guardian, and observed the uncleared staff does not have any fingerprint history. LPAs informed the director who informed the uncleared staff that she needed to leave the facility and obtain fingerprint clearance prior to returning to the facility.

LPAs observed a security guard that is armed at the facility who guided LPAs to the elementary main office. Per director and security guard, the armed security assist with the traffic flow of car-pool and patrols the facility's premises. Per the armed guard he is at the facility Monday to Friday from 7:30am to 5pm. The armed guard is from Global Security. Per the armed security he is primarily station in the his guard shack and does not any direct contact with the preschool children or staff. The facility is now in the process of requesting a waiver for the arm guard.

The following classrooms were inspected: Classroom 107: 9 children with 4 teachers; Classroom 103: 14 children with 4 staff; Classroom 102: 18 children with 4 teachers and Classroom 101: 15 children with 4 staff. Classroom 100: 17 children with 4 teachers. Teacher-child ratios were observed to be in accordance with Title 22 Regulations. Staff names were recorded. All children were observed to be under supervision, including visual supervision. Licensed facility is within the conditions, limitations, and capacity specified on the license.

The classroom furniture and equipment was inspected for good repair, free of sharp, loose, or pointed parts. All indoor classrooms were inspected to ensure that the floors have a surface that is safe and clean. All toilets and washing facilities are in safe and sanitary operating conditions. All materials and surfaces accessible to children are toxic free.

The facility does not provide any meals for children in care. The facility only an AM and PM snacks to children in care.

LPA observed that there are functioning smoke and carbon detectors in the facility. LPA observed a fully charged and serviced fire extinguisher. Emergency disaster drill was last conducted on 11/13/23.

Outdoor playground equipment is in safe condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. All areas around or under high climbing equipment, swings, slides, and similar equipment are cushioned with material that absorbs a fall. There is adequate shade in the play yard.


The facility uses an App called Pick my kid that is used to sign in and sign out the children.

Children’s Records were reviewed to ensure that Identification and Emergency form and a medical assessment are on file. Criminal Records Clearance for adults and verification of CPR/First Aid and health preventative practices documentation was reviewed.

SB792 (Immunization Requirements for Staff and Employees) was discussed with the Director. The Director and staff do currently have immunization documentation.

CCC COMPLETED TESTING AND NO LEAD EXCEEDANCES: Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP

Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Based on the LPA’s observations and records reviews, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety. The facility is being cited a Type A deficiency. Upon Receipt, licensee shall post and provide copies of this licensing report and LIC9224 to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. The facility is being cited an immediate $500 civil penalty for the uncleared adult, Tatiana Arie who was observed to be providing care and supervision to children.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

An exit interview was conducted, and a copy of the report was provided to director along with appeal rights.
