On 12/06/2023 at 9:00 AM Licensing Program Analysts (LPA`s) Shushanik Safaryan and Nolan Tcheng conducted an unannounced required 3-year inspection at the above facility to ensure the health and safety standards required by regulations governing family childcare homes are being met. A COVID-19 risk assessment was conducted prior to entering the facility. Upon arrival, LPA met with licensee Esther Davidoff and informed the reason of the visit. LPA observed 11 children with 2 assistants and licensee in the side yard. Hours of operation are Monday through Thursday,8:00AM to 5:00PM, Friday until 1pm.

Licensee guided analysts on a tour of the facility. Facility is two story duplex and the first floor used for childcare. LPA`s toured dining room (snack room), living room (classroom), den (napping room), kitchen, bathroom and completely fenced rear yard used as outdoor play area. LPA`s verified that all adults present in the home have obtained criminal record clearances and are associated to the facility. Verified with Licensee only 2 adults and 0 children live in the home and names were recorded on 811(confidential report).

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Poisons are locked in a off limits area. The restroom that children use was observed to be safe and sanitary.

All childcare employees must complete mandated reporter training within 30 days of hire and renew training every two years.

Licensee was advised of the requirement to report unusual incidents and/or injuries to the parent/guardian and Licensing within the time frame specified by the regulation and on the form LIC624B.

The licensee was informed of the responsibility to report suspected Child Abuse by calling the Child Abuse Hot line at 1-800-540-4000. Also call the CCL office and follow up with a written Unusual Incident/Injury Report (LIC 624B).

Regulation prohibits the smoking of tobacco in a private residence that is licensed as a family childcare home and in those areas of the family day care home where children are present (24/7 ban). State law prohibits baby walkers, bouncy seats, exersaucers and any other items that fall into that category.

LPA discussed the safe sleep regulations with licensee [or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.


A copy of Safe Sleep Regulations was provided to Licensee and reviewed. LPA provided a copy of LIC9227 and reviewed sleeping log with licensee.

During the exit interview, the licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with the licensee Esther Davidoff.

The facility was found to be following Title 22 Regulations. No deficiencies are being cited today, 12/06/2023.

The day care takes place in living room, dining room, hallway, bathroom, rear yard. The home is clean, orderly, comfortable, and well ventilated. There are toys available for children. Appropriate sleeping arrangements and cribs were observed.

LPA did observe a fireplace in the classroom area which was barricaded and inaccessible for children in care. The valve on the required 2A 10BC fire extinguisher indicates fully charged and was purchased 10/2023, licensee provided receipt . All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill documented was conducted on 10/19/2023.

Emergency Disaster Plan, Parent’s Rights Poster and the Facility License were observed to be posted in the hallway next to the entrance.
Currently, children are using the side yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA`s observed sand box which had a cover, storage box with the lock and inaccessible to the children. Per Licensee duplex had a swimming pool long time ago and was permanently filled and covered by city approved requirements. LPA did not observe any objects that can pose a danger to children on the outdoor yard.
Licensee's poisons, detergent, cleaning compounds, medications and other items which could pose a danger to child are stored where they are inaccessible to children. LPA observed working smoke detector and Carbon Monoxide, fully charged fire extinguisher, and working telephone.
There are several age-appropriate toys and a first aid kit on the premises. Per the licensee, there are no firearms on the premises. Licensee has current First Aid and CPR, expires07/2024.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. The licensee may find additional information and forms on the DSS website at www.ccld.ca.gov including information on the Live Scan application (LIC 9163). Appointments can be made for Live Scan at 1-800-315-4507

The following was discussed with the licensee: Capacity requirements, Roster requirements, Posting requirements, Documentation requirements for disaster drills (fire and earthquake). Mandatory Forms for the children’s files and provider’s files, and Safe Sleep Awareness. The role and responsibilities of being a mandated reporter were reviewed. Licensee was reminded that supervision is always required to children in care.

Licensee was made aware that it is their responsibility to know the regulations as well as anyone who assists in providing care. Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care. Licensing must always have the facility’s phone number; if the phone number is changed, licensing must be notified.
