On 12/19/2022 at 08:15 a.m. Licensing Program Analysts (LPAs) Deborah Lowe and Lilia Hernandez met with site supervisor Chana Hertzberg. The purpose of the visit was an announce case management inspection at the facility to ensure that health, safety and personal rights as requires by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were no children were present during this inspection. This is a capacity increase application for 36 Infants, ages 3 months to 24 months. The child care center will operate Monday – Friday 7:30 a.m. – 5:30 p.m. The fire clearance was approved on 11/02/2022. Licensee has a pending capacity increase application for the preschool license 197417887.

LPAs Lowe and Hernandez toured and measured the on-limits areas and classrooms located at the facility. The facility has a total of 1 infant classroom. The infant room is located in the main building next to the lobby. The Infant classroom was observed to be one room with a child gate dividing the room, with an additional room off of the main room and a separate crib room off of the main room. Infant room was observed with two refrigerators and an island area near the counter space. Children will have access to 2 sinks and 1 potty chair for potty training infants. Fire extinguisher was observed with a service date of 09/06/2022.

Classroom measurements are:

Indoor total measurements: 1106.68 square (sq) feet (ft) divided by 35 sq ft = 31 infants.

Outdoor Play measurements are:

Outdoor total measurements: 1304.98 sq ft divided by 75 sq ft = 17 infants.

All outdoor and indoor passageways, stairways, inclines, ramps, open porches and other areas of potential hazard were observed to be free of obstruction. The child care center was observed be clean, safe, sanitary and in good repair to ensure the safety and well-being of children, employees and visitors. Floors in the infant rooms were observed to be clean, with one area near the island to be in need of repair. A comfortable temperature for children was observed. The infant care center was observed to be equipped with appropriate furniture and equipment including, but not limited to, cribs, mats; changing tables; and feeding chairs. Tables and chairs were observed to be meet the needs of the children. Furniture was observed to be maintained in good repair and safe condition.

LPAs observed the indoor type, height and size of furniture and equipment to be age appropriate. LPAs advised swings, playpens and all such equipment and furniture shall be assembled or installed according to the manufacturer's instructions, and shall be maintained in good repair and safe condition. Toys were observed to be safe, and did not have sharp points or edges or splinters, or be made of small parts that can be pulled off and swallowed. Rattles were observed be large enough so that they cannot become lodged in an infant's throat and constructed so that they will not separate into small pieces.

LPAs observed individual permanent storage space for children's clothing, personal belongings and/or bedding. All materials and surfaces accessible to children, including toys, were observed to be free of toxic substances.

Infants bring own bottles and water bottles and facility has drinking water available from a noncontaminating fixture or container. Per Director facility has a monthly pest control service to keep the center free of flies, other insects, and rodents. LPAs observed trash cans to be located in a cabinet, in good repair, and inaccessible to infants. No fireplaces or open-faced heaters were observed. All window screens shall be in good repair and free of insects, dirt and debris.

LPAs advised disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. LPAs advised storage areas for poisons shall be locked. LPA observed a current edition of a first-aid manual, sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution.

Any infant in the isolation area shall be under constant visual observation by a director, an assistant director, a teacher or an aide. Isolation area is located in the director office area.

LPAs advised the isolation area shall be equipped with a crib, cot, mat or playpen for each ill infant. LPAs advised the isolation area shall not be located in the kitchen area or the general-use toilet area.

LPAs observed three carbon monoxide detectors in the facility. LPA Lowe verified a working telephone service on the premises.

Facility is using daily sign in and out sheets with a space for parents full signature.

LPAs advised the licensee shall be responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted.

LPAs advised smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). LPAs advised a baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c).

LPAs advised there shall be at least 35 square feet of indoor activity space per child based on the total licensed capacity.

Napping:

LPAs observed 13 standard size six-year crib provided for each infant who is unable to climb out of a crib. LPAs advised stacking wall cribs or cribs stacked one on top of another, often referred to as tiered

cribs, shall not be permitted. LPAs advised cribs shall not limit the ability of staff to see the infant. Crib mattresses were observed to be: Covered with vinyl or similar moisture-resistant material. Crib mattresses were observed to be: Maintained in a safe condition with no exposed foam, batting or coils.

Floor mats or cots that meet the requirements of Section 101239.1(b) shall be provided for all infants who have the ability to climb out of a crib. LPAs observed floor mats. LPAs advised each crib, mat or cot shall be occupied by only one infant at a time. Each infant's bedding shall be used for him/her only. Such bedding shall be replaced when wet or soiled, or when the crib, mat or cot is to be occupied by another infant.

LPAs advised the calculation of indoor activity space for infants shall not include space designated and used for cribs. The sleeping area for infants shall be physically separate from the indoor activity space.

LPAs observed a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities.

Infant Changing Tables

LPAs observed to have a padded surface no less than one-inch thick and be covered with washable vinyl or plastic. Have raised sides at least three inches high. Be maintained in good repair and safe condition. While in use, be placed within arm's reach of a sink. Not be located in the kitchen/food-preparation area.

Restrooms:

There shall be a minimum of one hand washing sink to every 15 infants and one potty chair to every five infants being toilet trained. Infant classroom is without a children’s restroom. Potty chairs were observed for use of potty training infants.

Outdoor:

LPAs advised outdoor activity space shall be physically separate from space used by children in the child care center and child care center components.

LPAs observed a shaded rest area for the children. Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. Wooden climber structure located on Infant yard was observed to be not age appropriate. LPAs advised sandboxes shall be inspected daily and kept free of hazardous foreign materials.

The playground shall be enclosed by a fence to protect children and to keep them in the outdoor activity area. The fence was observed to be at least four feet high.

LPAs advised any construction or equipment that could pose a hazard in the outdoor activity area shall be made inaccessible to children in care. This shall include, but not be limited to, incinerators, air- conditioning equipment, water heaters, and fuse boxes.

LPAs advised water fountain located on Infant Art Yard was observed as a body of water. Fountain shall be made inaccessible to children or removed from yard.

LPAs advised there shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity.

Health Related Services:

Medications were observed to be kept in a safe place inaccessible to children. A refrigerator shall be used to store any medication that requires refrigeration.

LPAs reviewed facilities written plan to record the administration of prescription and nonprescription medications and to inform the child's authorized representative daily when such medications have been given.

Food Service:

Prior to the infant's first day at the center, the infant care center director or assistant director shall complete a needs and services plan for the infant. High chairs or other appropriate seating equipment was observed to be used to seat infants during feeding. Infants who are unable to sit unassisted in a high chair or other seating equipment shall be held by a staff person or other adult for feeding.

LPAs advised bottles, dishes and containers of food brought by the infant's authorized representative shall be labeled with the infant's name and the current date. LPAs advised the infant care center shall not serve honey or corn syrup to any infant.

LPAs advised all food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. All food shall be selected, stored, prepared and served in a safe and healthful manner.

LPAs advised all foods or beverages capable of supporting the rapid and progressive growth of microorganisms that can cause food infections or food intoxications shall be stored in covered containers at 45 degrees F (7.2 degrees C) or less. LPAs observed kitchen refrigerator at a temperature of 37 degrees.

LPAs advised pesticides and other similar toxic substances shall not be stored in food storerooms, kitchen areas, food-preparation areas, or areas where kitchen equipment or utensils are stored. No pesticides or toxic substances were not observed.

LPAs advise soaps, detergents, cleaning compounds or similar substances shall be stored in areas separate from food supplies.

LPAs observed the kitchen, food-preparation and storage areas to be clean.

LPAs advised the food-preparation area shall not be used for: Children's play activities, unless such activities are part of a supervised food-education program.

Postings:

LPAs observed the following required postings located in the lobby: Facility license, LIC 613A (9/96), PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster, LIC 9148 Emergency Disaster Plan, and information on child passenger restraint systems pursuant to Health and Safety Code section 1596.95(g) and Vehicle Code sections 27360 and 27360.5

Menus were observed to be in writing and posted at least one week in advance located in the lobby and the individual classroom. Copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request.

LPAs advised each licensee shall have a disaster and mass casualty plan of action.

LPA advised the licensee shall reveal each child care center license number in all advertisements in accordance with Health and Safety Code Section 1596.861.

Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

The following corrections are needed before a capacity increase will be considered. Corrections are due by 12/30/2022:

· Child proof end caps of exposed child gate near infant play area

· Floor area near island is in need of repair

· Child proof drawers and cabinets accessible to children

· Remove outdoor wooden climber (intended for ages 2 years – 8 years)

· Repair gate latch on art yard – latch does not securely close

· Outdoor area on art yard – make folding table storage inaccessible to children

· Fountain located on Outdoor Art yard was observed to be a body of water need to be made inaccessible to children or removed.

  • Outdoor waiver request with planned schedule.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

An exit interview was conducted with the above items discussed and a copy of appeal rights and this report was provided to the Chana Hertzberg, Director. Final license determination will be made upon review by the Licensing Program Manager and correction of the above issues.
