On 08/26/2021 at 12:30 PM, Licensing Program Analyst (LPA) Adrian Risher, conducted a complaint visit regarding the above-mentioned allegation. Upon arrival, LPA met with Cheryl Muhammad, Director. LPA explained the purpose of the inspection. LPA observed 19 children in care with 3 staff.

Reporting Party stated that a staff member hit their child while they were at the daycare.

On 06/15/2021, LPA Risher conducted the 10 day visit for the above allegation. During the visit, LPA interviewed the Director, Staff and children. Director stated that they use core knowledge words to get the children to self correct. Staff also have the children move to the back row to sit until they are ready to join the class. Staff stated that they have the children sit in the back row. Children stated that they get hit when they get in trouble at the daycare.

On 08/19/2021, LPA Risher returned to the facility to conduct additional children’s interviews. Children stated you get a sad face or they are sent to the back row if you do not behave at school. Children also stated that they are hit with a stick when they are not listening to the children. Children appeared intimidated by this stick(pointer) that is being used in the facility.

Based on the investigation which included interviews with relevant parties and observations by the LPA, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, Article 06, Section 101223 is being cited on the attached LIC 9099D page. The facility will be cited for a Personal Rights violation.

Director was advised that each parent or child representative must sign the LIC 9224 Acknowledgement of Receipt of Licensing Report and return by the close of the business day or upon the next day that the child returns to the facility. Parents or guardians of newly enrolled children within the next 12 months need to be provided with a copy of the licensing reports and place the LIC 9224 in each child's file.



Exit interview was conducted and a copy of the report was provided. Appeal rights were reviewed and provided. A plan of correction was discussed and provided to the Director.

Director will schedule an In-Service meeting for staff about Personal Rights. Director will conduct training with agenda that includes Title 22 center-based regulations(101223) and Personal Rights video. Staff will write a declaration stating that they watched the
video and read/understand Title 22 101223

This requirement was not met as evidenced by: Staff did not ensure that the children's Personal Rights were secured by refraining from hitting the children in care which poses an immediate risk to the health & safety of the children in care.

Personal Rights. Facility will update disciplinary policy with the step-by-step method that will be used when children are not behaving and provide it to the parents. Facility handbook with be amended with this update. Director will provide the declarations & updated policy to LPA by 09/09/2021.
