On 02/21/2023 Licensing Program Analyst (LPA) Deborah Lowe met with Facility Representatives, Regina Leybovich and Arina Faynshteyn. The purpose of the visit was an announce case management licensee initiated inspection at the facility to evaluate proposed changes to the facility outdoor play area.

LPA Lowe observed 12 children under supervision of 3 staff. LPA Lowe toured indoor and outdoor of facility with Regina Leybovich and Arina Faynshteyn.

Per Child Care Center Regulation 101237(a) Alterations to Existing Buildings or New Facilities (a) Prior to construction or alterations, the licensee shall notify the Department of the proposed change(s) and Child Care Center Regulation 101212(c) Reporting Requirements, (c) The licensee shall notify the Department in writing of his/her intent prior to making any structural changes that reduce the total amount of indoor or outdoor activity space.

On 02/03/2023 the Licensee notified the Department that Toluca Crossroads was awarded a minor renovation grant. The Licensee’s notification stated the facility will use the grant to remodel the existing playgrounds.

On 02/21/2023 LPA Lowe met with Facility Representatives, Regina Leybovich and Arina Faynshteyn to discuss and review how the facility will conduct the proposed changes while ensuring the Health and Safety of the children.

LPA Lowe advised; the purpose of LPA Lowe is to consult with the facility on the proposed temporary outdoor play usage for Infants during the remodel of the existing playgrounds. The Licensee will make the final decision on the temporary outdoor play area that will be used during the remodel to the existing playgrounds.

LPA Lowe observed two outdoor Infant play yards, one is located on the deck next to the preschool outdoor play area and the other is located on the side of the infant building near the infant room. Per Regina, the Infant outdoor area located on the side of the infant building will remain in use. All construction or changes to

that infant yard will be completed over one weekend. The Infant outdoor area located on the deck will be closed during construction of the preschool playground renovation. Closure of the deck will result in loss of outdoor square footage.

LPA Lowe measured the Infant Outdoor Activity Space:


Infant yard located on the side of infant building: 359.78 square (sq) feet (ft) divided by 75 sq ft = 4 infants.
Infant yard located on the deck near preschool yard: 224.57 sq ft divided by 75 sq ft = 2 infants

LPA advised, Per Regulation 101238.2 Outdoor Activity Space (a) There shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity.

LPA advised, based on measurements facility will need to request an outdoor waiver. LPA advised; waivers are reviewed on an individual basis by the Department.

LPA did not observe any construction at this time. Per Regina, they are working with a contractor, the contractor will apply for permits and once permits and waivers are approved Regina will notify the Department of actual dates of construction.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

An exit interview was conducted with the above items discussed and a copy of appeal rights and this report was provided to the Facility Representatives, Regina Leybovich and Arina Faynshteyn.
