32 | Allegations 5 - Facility staff did not meet a daycare child's diapering needs.
The Reporting Party (RP) is reporting that on 3/10/21 and 3/17/21 Child 1 (C1) was picked up early from school and had poop in diaper. RP is reporting that C1 has been attending the facility for 2 years and never had any issues until now. The RP and Facility Staff are reporting that children’s diapers are changed prior to being picked up. Facility staff are reporting that they offered to change C1’s diaper when RP notified staff of the soiled diaper on 03/10/21
Allegations 6 - Facility staff did not provide daycare child an alternative activity during naptime.
The Reporting Party (RP) is reporting that on 03/10/21 and 3/17/21 staff (name unknown) called RP and said that C1 needs to be pickup because C1 would not be quiet during nap time. According to the reporting Party they were not made aware of any behavior issue prior to the two week period when C1 was sent home. The facility staff are reporting that C1 was sent home because he was not behaving during nap time and would not allow other children to rest. Staff provided C1 with books, soft toys and redirected C1 in effort to gain compliance from C1. Staff decided to send C1 home due to C1’s disruptive behavior and refusal to comply during nap time. Staff are reporting that during nap time children are required to stay in their beds, sleep, or read a book quietly in order to allow other children the opportunity to sleep.
Based on available information and evidence obtained over the course of the investigation LPA is unable to determine that Allegations 1 - Facility is operating out of ratio; 2 - A daycare child bit another daycare child; 3 - Facility did not report a daycare child's injury to the parent ; 4 - Facility staff handled a daycare child roughly; 5 - Facility staff did not meet a daycare child's diapering needs; 6 - Facility staff did not provide daycare child an alternative activity during naptime did or did not occur. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation(s) is unsubstantiated.
There are no deficiencies being cited on this report. An Exit Interview was conducted, a copy of this report, and Notice of Site Visit were explained and emailed to the Director ARINA FAYNSHTEYN. It has been explained that a reply to the email shall be considered a substitute for the hard-copy signature.
