32 | The Department has concluded, based on the preponderance of the evidence obtained during this investigation, that both allegations of Staff are not following proper COVID-19 mask guidance and of Staff restrained infants in care are substantiated.
Substantiated: The preponderance of evidence standard has been met.
The deficiencies are being cited per California Code of Regulations, TITLE 22, DIVISION 12, CHAPTER 1 Articles 1-7. Please see LIC 9099D (Complaint Investigation Report Cont)
An exit interview was conducted with the Director, in which this report was read to her. The Director was advised that the Notice of Site Visit and a copy of this report must be posted at the entrance of the facility for a period of 30 days. Failure to post will result in civil penalties of $100.
In addition, A copy of this report must be provided to parent of authorized representatives of all currently enrolled children and any newly enrolled child for the following 12 months.
The ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC9224) shall be signed and kept in each of the children’s records. The report shall be provided no later than the next business day or the next day the child is in care. Appeal rights provided and explained. The licensee was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above. Licensee was informed of how/where to access regulations and forms from CCLD website.
