On 04/27/2022 at 11:05am Licensing Program Analyst (LPA) Laticia Thompson conducted an unannounced visit to THE BEGINNING MONTESSORI CHILDREN'S HOUSE INC. LPA met with SUNETHRA IPALAWATTE (Director). LPA advised the Director of the reason for the visit today is to deliver the findings of the complaint received on 02/02/2022, regarding the allegations referenced above. LPA observed 6 infants and 2 staff.

During the course of the investigation, based on LPA’s interviews with S#1 and LPA’s observation during site visit, LPA was able to substantiate that Staff were not following proper COVID-19 mask guidance. Per PIN 21-29CCP dated 11/23/21which was still in effect on 2/2/22, masks were to be worn in Child Care setting by all person over the age of 24 months when inside and outside.

The allegation of Staff restrained infants in care has also been substantiated. Based on LPA’s interviews with S#1 it was revealed that staff leaves children in cribs for 2 hours if not napping or playing.

The Department has concluded, based on the preponderance of the evidence obtained during this investigation, that both allegations of Staff are not following proper COVID-19 mask guidance and of Staff restrained infants in care are substantiated.

Substantiated: The preponderance of evidence standard has been met.

The deficiencies are being cited per California Code of Regulations, TITLE 22, DIVISION 12, CHAPTER 1 Articles 1-7. Please see LIC 9099D (Complaint Investigation Report Cont)

An exit interview was conducted with the Director, in which this report was read to her. The Director was advised that the Notice of Site Visit and a copy of this report must be posted at the entrance of the facility for a period of 30 days. Failure to post will result in civil penalties of $100.

In addition, A copy of this report must be provided to parent of authorized representatives of all currently enrolled children and any newly enrolled child for the following 12 months.
The ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC9224) shall be signed and kept in each of the children’s records. The report shall be provided no later than the next business day or the next day the child is in care.
Appeal rights provided and explained. The licensee was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above. Licensee was informed of how/where to access regulations and forms from CCLD website.

During the investigation of Allegation 1 and 2 referenced above revealed, there is not sufficient evidence to support nor deny that the allegations occurred. LPA interviewed parents, staff and Director and was unable to confirm that an Infant sustained unexplained injuries while in care and parent was not notified of child's incident , therefore the allegation is unsubstantiated
Unsubstantiated: A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation occurred
The Licensee was advised that the Notice of Site Visit and a copy of this report must be posted at the entrance of the facility for a period of 30 days.
