On October 9, 2020, LPA Tsutaoka conducted an unannounced case management virtual tele-visit inspection with Director Karen Allen regarding an incident that occurred on October 7, 2020. A tele-visit was conducted as a COVID-19 safety precaution. Using Facetime, Director took LPA on a tour of the facility where LPA observed the preschool playground, the breezeway where outdoor toys are stored, and the school aged playground leading to the security gate next to a grass area located behind the Centennial Chapel next to the parking lot. From information gathered, Child 1 exited the security gate and was found by a parent on the grass area outside of the preschool .

On October 7, 2020 between 9:00AM and 9:30AM, Staff 1, Staff 2, Staff 3, and Staff 4 were outside with Staff 1's classroom and Staff 2's classroom consisting of 15 children total. At approximately 9:20 AM, Staff 3 redirected Child 1 away from a grass area while he was riding a tricycle. Staff 3 rolled the tricycle away and watched as Child 1 ran to the sand area near the small climbing structure with a slide and saw him begin to play with sand toys. At approximately 9:25 AM Staff 1 rang the bell for the classes to line up to go inside. At 9:30 AM, the 3-year-old classes are scheduled to use the yard and Staff 1 rings a bell to notify children and staff it is time to line up to go inside to prevent the separate age groups from commingling. Staff 1 had Child 2 and conducted roll call with the children by the classroom door and asked Staff 3 to go get Child 1 from the large climbing structure. Staff 3 stated Child 1 was not on the climbing structure. Staff 3 walked around the play yard calling to Child 1 and did not find him. Staff 3 stayed with the children while Staff 1 and Staff 2 looked in Staff 1 and Staff 2's classrooms. They searched in the cabinets, in the bathrooms, and in the adjoining kitchen that connects the two classrooms.

supervising 15 children during outdoor play. Child 1 exited the play yard through a gated breezeway which was left unlocked. Child 1 walked through the breezeway, through the elementary playground to a security gate, opened the gate, and was found on the grass outside the gate behind the Centennial Chapel next to the parkinglot outside the preschool. This is a Type A violation. This deficiency poses an immediate risk to the health and safety of children in care. $500.00 immediate civil penalty was assessed.

At approximately 9:32 AM, after looking for Child 1 inside the classrooms, adjoining kitchen, and outdoor play area, Staff 1 called Director and stated they could not find Child 1. Director met with Staff 1 and looked for Child 1 in the front area of the school where parking lot is located. Director returned to office to radio Parent 1, who is also a staff member for Desert Christian Schools, to come to the office. Before Parent 1 met with Director, a parent with home school event (name unknown) came to the front entrance of the school and brought Child 1 to the office. Director told Staff 6 they were looking for Child 1. Staff 5 overheard and told Director, "He is right here." Director called to Staff 1 who was on the playground that Child 1 was found and he was at the front of the school.

Director waited until Parent 1 arrived to go speak to parent who found Child 1. Staff 1 walked over to Child 1 and picked him up. Director, Parent 1, Staff 1, went into the office to meet parent who found Child 1 and Child 1. Parent who found Child 1 stated she was talking to another parent when she found Child 1 on the grass located in the back of the school in the back of the church. She picked him up and brought him to the front of preschool. Parent does not know how child got out. Parent 1 disclosed Staff 1 handed him Child 1 and Child 1 discussed a black cat 2D image sticker. Child did not discuss what had happened, was not crying, but seemed overwhelmed with the amount of people in the room. Staff 1 took Child 1 back to class.

While Staff 1 was looking for Child 1 in playground, she noticed the padlock for the breezeway meant to store outdoor toys was missing, but the chain was still attached. Director informed Parent 1 that padlock was missing and gate was unlocked, to which he promptly located the padlock and relocked it.

Staff 1 disclosed she had Child 1 demonstrate how he exited the play yard while they were outside during the second outdoor play time later that afternoon. Child 1 walked to breezeway which is used to store outdoor toys. Child 1 unlatched the first gate, walked through the breezeway, unlatched the second gate, and jiggled the gate in an attempt to open it. The chain and padlock had been returned at that time.

During a Facetime call, Director showed LPA the breezeway located between E Building and D Building where Child 1 exited from. Director turned right into the elementary school play yard, walked approximately 38.11 yards to a security gate which is easily opened from the inside. Child 1 was found on the grassy area behind the Centennial Chapel right outside that security gate. The grass leads to a parking lot which is approximately 40.94 yards from where Child 1 was found. LPA observed as Director and maintenance technician took measurements of both distances separately.

Based on information gathered during the investigation, it does appear a violation of Title 22 Regulations occurred when the gate to the breezeway was left unlocked, allowing a child to exit the play yard, walk through the elementary playground, and exit a security gate to the grass area located behind the Centennial Chapel leading to the parking lot.

The facility was cited a Type A deficiency per Title 22 regulations. Please see LIC809D for details. An immediate civil penalty has been assessed as a result of Lack of Care and Supervision.

Director was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. A copy of this licensing report (LIC809) must also be posted for 30 days. If these requirements are not met, civil penalties in the amount of $100 per violation will be assessed. Copies of the reports must also be provided to each parent and a copy of the Acknowledgment of receipt of licensing report (LIC9224) must be kept in each child's file. In addition, any child enrolled within the following 12 months must also receive a copy of the Type A Citation.

An exit interview was conducted and a copy of this report was read. The report will be mailed and emailed with read receipt to the Director, Karen Allen.
