Personal Rights - Napping infant was not placed in crib

Licensing Program Analyst (LPA), V. Wheatley conducted an inspection to investigate the above allegation. LPA met with the director Gabriela Garcia at 1:15PM. The director was supervising 6 infants alone. LPA inquired if there were any other staff to supervise the children so the LPA could discuss the allegation. LPA was told that the staff on the premises were on break until 2PM. LPA interviewed the director and Staff #1. The director and Staff #1 submitted declarations. LPA reviewed staff records. The other employee, Staff #2 that was present during the day of the incident is absent today.

Based on the LPA's investigation, interviews which were conducted and information obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. The staff member #2 did not place a sleeping infant child in a crib for napping. The infant child was observed asleep in the staff member's arms. This is a violation according to Title 22 Regulations. LPA provided a copy of Safe Sleep brochure with the correct sleeping / napping proceedures.

Exit interview. A copy of this report and LIC 9224 form was provided to the director.

Licensee/director will ensure that children are accorded safe, healthful and comfortable accomodations. The director will submit a plan of correction to the department regarding ensuring infants are napping in requied napping equipment to prevent SIDS. The plan will be submitted to the department by 3/11/2020. The director will also meet with staff regarding proper infant sleeping and SafeSleep procedures

Based on information obtained through interviews, Staff #2 did not place an infant that was asleep in her arms in a crib. This requirement is not met as evidenced by Title 22 Regulations. This is an immediate risk to Personal Rights of children in care.
