On May 5, 2022 at 1:35PM, Licensing Program Analyst (LPA) Brigitte Tsutaoka conducted an unannounced complaint inspection to deliver findings on the above allegation. LPA disclosed the purpose of inspection and was granted entry by Assistant Director Ana Garcia, who guided LPA on a tour of the facility. Upon entry, LPA observed 1 child with 2 staff on association list. LPA observed school age room decorated for Cinqo de Mayo, a table museum set up for the children, and the staff engaging in the La Raspa dance with the child in attendance. LPA observed 1 child be picked up early by parent. At 2:20, Director Jessica Donis arrived at the facility. At 4:00PM, 22 children arrived at the facility after school.

During the course of the investigation, LPA conducted interviews with staff, children, parents, and obtained facility records. Evidence collected determined children ride in the facility van with approximately 6 children, are all required to utilize seat belts, and the smaller children sit in a booster seat. Interviews indicated no children are permitted to sit on the floor. Additionally, LPA confirmed staff have current valid driver's licenses that have not yet met the expiration date.

On May 5, 2022 at 1:35PM, Licensing Program Analyst (LPA) Brigitte Tsutaoka conducted an unannounced complaint inspection to deliver findings on the above allegation. LPA disclosed the purpose of inspection and was granted entry by Assistant Director Ana Garcia, who guided LPA on a tour of the facility. LPA observed 22 children with 2 staff on association list.

During investigation, LPA conducted interviews with staff, children, parents, and obtained facility records. Based one interviews conducted with staff and parents, it was disclosed the children are commingled during weekends and late in the evenings when child enrollment has decreased. Additionally, based on record review, LPA observed facility staff time sheets and child sign-in sheets. During October 2021, LPA determined the facility was out of ratio on the following dates after 6:00PM: 10/12 (1:17), 10/13 (1:16), 10/14 (1:16), 10/15 (1:17), 10/19 (1:19), 10/25 (1:17), 10/27 (1:18), and 10/28 (1:15). The facility was out of ratio by between 1 to 4 children on the before mentioned dates.

LPA also determined on 10/14, 10/15, and 10/21, the preschool and school age children were commingled in the same class after 8:00PM when the school age teacher has left for the day.

Additionally, based on interviews with children and parents, facility staff were late to conduct pick ups with children in a timely manner. Children disclosed the facility staff were approximately 30 minutes late to pick them up from school. Parents disclosed the facility has been late to pick up their children on multiple occasions, which resulted in the parent having to conduct the pick up from their child's school.

Based on evidence obtained and observations conducted, the preponderance of evidence standard is met and the above allegation is substantiated. California Code of Regulations, Title 22, Division 12 Chapter 1 101538.3 Indoor Activity Space for School-Age Children and 101516.5 Teacher-Child Ratio Type A violations are being cited during this inspection. California Code of Regulations, Title 22, Division 12 Chapter 1 101223 Personal Rights Type B violation is being cited during inspection. See LIC9099D for deficiency details.

Director was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. A copy of this licensing report (LIC9099) must also be posted for 30 days. If these requirements are not met, civil penalties in the amount of $100 per violation will be assessed. Copies of the reports must also be provided to each parent. A copy of the Acknowledgment of receipt of licensing report (LIC9224) was
provided and must be kept in each child's file. In addition, any child enrolled within the following 12 months must also receive a copy of the Type A Citation.
