Licensing Program Analyst (LPA), V. Wheatley conducted an announced inspection today at 9:40am because the school is currently closed. LPA met with licensee Nilofer Quaid at 9:40am. LPA did not observe any day care children present today. LPA conducted an inspection on 5/2/2022 and was unable to meet with the licensee as she was unavailable due to a Muslim Holiday Eidulfitr.

Today, LPA took the licensee's statement in which she states Child #1 was outside playing on March 24, 2022 and stood on a chair. Another child pulled the chair from underneath Child #1 causing the child to fall down. The child sustanted an injury to the finger which required several stitches. LPA also interviewed the child's parent. The licensee submitted LIC 624 (unusual incident/injury report) in a timely manner.

Based on the LPA's investigation and interviews which were conducted, the preponderance of evidence standard has been met, the above allegation is substantiated. The facility is being cited for a Type A violation see LIC 9099D. A civil penalty of $500 is being assessed for the child's injury.

Evidenced by

The licensee allowed Child #1 to stand on a chair which was unsafe. The child sustained an injury to the finger on March 24, 2022 which caused several stitches due to another child pulling the chair from underneath the child. This is a posses an immediate risk to the health and safety of children.

Today, LPA interviewed the licensee regarding the above allegations in which she denied any unsafe equipment on the outdoor yard. In addition, licensee denied taking a class online on a computer while supervisng children. She states during the Pandemic she was required by Head Start to conduct learning with the children on Ipads. There are no staff or children to interview as the facility is closed. LPA did not observe any unsafe equipment today or on May 2, 2022 during an inspection.

Based on the LPA's observations, information obtained and interviews which were conducted, there is not a preponderance of evidence to substantiate the allegations, therefore the allegations are Unsubstantiated. The unsubstantiated finding means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
