On 04/17/23 at 2:15 PM, Licensing Program Analyst (LPA) Andrew Alemoh met with Assistant Program Director Sandra Culini-Reza for the purpose to deliver the finding of the above allegation. Upon arrival, LPA observed 5 staff members providing care to 31 preschool age children.

The investigation consisted of interviews with Director, and other complaint relevant parties. During the interviews conducted, staff #1 and staff #2 revealed child #1 experienced frustration and behavioral issues such as throwing toys across the room to staff and children. Child #1 would use his hands to communicate resulting in pushing (staff #3 child #2), staff/children, tapping them on the head and throwing objects/toys without resulting in any injuries. LPA obtained statements documenting of child #1’s observations. The facility staff was in communication with child #1’s authorized representative as the following dates: Jan 17th, 31st, Feb 1st 2nd and 5th. The facility provided resources to seek assistance to help with child #1’s behavioral issues. On Feb 5th, 2023, child #1 was disenrolled due to the facility being unable to meet child #1’s needs. Director stated an all staff meeting will be conducted to discuss how to prevent personal rights violations of children. Licensee will submit to the Department no later than 05/01/23 a copy of the all staff meeting agenda including the meeting sign in and out with the signatures of staff that participated

multiple occassions child #1 threw toys and objected to these children. The incident did not result in any injuries. This is a type B deficiency which poses a potential Health, Safety or Personal Rights risk to persons in care.

The facility was unable to meet the needs of child #1 as a result (other child #2) were affected by child #1's behavioral actions Based on the evidence obtained, there is sufficient evidence to prove child #1 threw toys and objects to staff and children; therefore, the allegation is substantiated.

The facility was cited a Type B deficiency. See Complaint Investigation Report LIC9099-D for deficiency cited.

On 04/17/23 at 11:xx AM, Licensing Program Analyst (LPA) Andrew Alemoh met with Assistant Program Director Sandra Culini-Resa for the purpose to deliver the finding of the above allegation. Upon arrival, LPA observed assistant program director providing care to 31 preschool age children and 5 staff members.

The investigation consisted of interviews with Director, and other complaint relevant parties. During the interviews conducted with staff and children there were no witnesses that can corroborate the above allegation occurred.

Based on the evidence obtained, the above allegation is unsubstantiated.

An exit interview was conducted, a copy was read and provided to the xx along with the appeal rights.
