On 04/13/2021 at 11:12 am, Licensing Program Analyst (LPA) Sabrina Martinez conducted the complaint investigation via tele-visit for the purpose of investigating the above-mentioned allegations. This complaint investigation was conducted by tele-visit due to the COVID-19 pandemic and the Safer at Home Order issued by California State Governor Gavin Newsom.

LPA spoke with Crystal Thompson, licensee, and discussed the purpose of the tele-visit. LPA observed four (4) children present being supervised Staff #1. LPA observed the children in the school age classroom engaged in various table activities. LPA obtained the names and dates of birth of the children present in both programs and observed that Child #1 and Child #2 are both school age children and were comingled with the preschool children.

An interview was conducted with Crystal Thompson, licensee, who stated that Child #1 was in the preschool classroom because she needed help with Zoom Class. Licensee stated that Child #2 was in the

preschool classroom because licensee was not aware that she was a school age child and should have been enrolled in the school age program. LPA conducted an interview with the school age children who stated that they would have am/pm snack, lunches and outdoor play activities while being comingled with the preschool children.

LPA requested that licensee provide a copy of the Child Care Facility Roster (LIC 9040), Personnel Report (LIC 500), Children’s sign in/sign out sheet for the period of March 29-April 09, 2021 and Staff sign in/sign out sheet for the period of March 29-April 09, 2021.

Based on LPA’s observations during today’s visit, interviews with children and licensee’s disclosure, the allegation that staff are commingling school aged children with the preschoolers is substantiated. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met. The facility is cited Type A citation today, 04/13/2021. See LIC 9099-D for deficiency page.

Licensing Reports Given to Parents Required ( Assembly Bill 633) Upon receipt by the Applicant/Licensee, Licensees are to provide to parents/guardians the following: Copies of any licensing reports that document a Type A citation- this includes facility visits and substantiated complaint investigations; copy of licensing documents pertaining to a conference conducted by a local licensing agency management representative and the licensee of this family child care home in which issues of noncompliance are discussed or copies of a summary of an accusation indicating the Department's intent to revoke the facility's license. Copies of any of the above licensing documents the licensee has received in the prior 12 months shall be provided to parents/guardians of newly enrolled child at the facility.

Licensee was provided with the Acknowledgment of Receipt of Licensing Reports (LIC 9224) (12/06). Licensee shall require the parent/guardian to sign and date the statement and shall keep the signed statement as a receipt. The licensee shall keep verification of receipt in each child’s file at the facility.

A copy of this report, Notice of Site Visit, and appeal rights are being emailed to Crystal Thompson, licensee, and it has been explained that a reply to the email shall be considered a substitute for the hard-copy signature.
