On 01/08/2019 at approximately 12:10 am, Licensing Program Analysts (LPAs) Antonio Almanza and Erika Hill conducted an unannounced annual/random inspection at My Discovery Gardens Children’s Infant Center. LPA’s met with the Center Director Rachelle Rigsby and a tour of the facility was guided by Aid Courtney Iakopo. The facility is located on the corner of Biloxi and Magnolia. The facility is located in a home-based center. The facility has a dual license in the building with My Discovery Gardens Children Center FAC: 197493920. The Napping room for the infants separates the two centers.

Upon arrival, This LPA observed 3 children napping and 4 children engaged in activities with the teachers. There was a total of 6 infants present and 3 staff members providing supervision. Criminal record clearances of all adults and association to the facility was verified. LPA reviewed the sign in and sign out sheets to verify the census of children.

A walk through of the room space was conducted. The space was found to be clean, orderly and free from any potential hazards. Furniture was found to be in good repair and age appropriate. There is adequate heating, lighting and ventilation. Isolation area for sick students is in office.

There are two chaining tables in the facility with sink at arm’s reach. One located in nap room on the north west corner of the facility and the other in activity room in the south east corner of the facility. The changing tables have adequate cushioning and cleaning supplies available. LPAs observed 4 cribs that were clean and in good repair. LPAs observed 2 Nest cameras in the nap room that are functional and are viewed via ipad.

The facility provides meals and snacks for children. Parents bring formula and breast milk for children in care. There was a menu posted. Food preparation area was toured for safety, cleanliness and proper equipment. Food and snacks were reviewed for availability, quantity and appropriateness to children in care. A review of cleaning and food supply storage areas was made. Outdoor equipment was inspected for safety, cushioning material, good repair and age appropriateness. Required shade, drinking water and fencing were inspected. Play area was inspected for hazards and inaccessibility to bodies of water.

The facility has functioning fire extinguisher and smoke detectors that meet requirements. LPA observed a fully charged 2A10BC fire extinguisher (service date 01/21/2019). File review was conducted for staff and children. There is at least one staff that has completed the training for Adult and Pediatric CPR. All staff files reviewed have current Mandated Reporter Training.

This facility does provide Incidental Medical Services – IMS. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The licensee was advised how to access forms and Regulations for Child Care Center online at www.ccld.ca.gov. Licensee was made aware that it is their responsibility to know the regulations as well as anyone who assists in providing care. Licensee was advised on how to access quarterly reports, forms, and regulations for Child Care online at www.cdss.ca.gov. The licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care. Licensing must have the facility’s phone number at all times; if the phone number is changed, licensing must be notified. Regulation prohibits the smoking of tobacco on the premises.

The Center Director was informed of The Child Care Advocate Program (CCAP) that is administered from within the Community Care Licensing Division. CCAP participates in many community activities and special projects in order to disseminate information on the State’s licensing role, provide information to the public and parents on child care licensing, and provide many other helpful resources to the licensees and the public. The following were also discussed with the Center Director:

Assembly Bill 633: Upon receipt of a citation for a Type A Deficiency, the director shall post the licensing report for 30 days in addition to the Notice of Site Visit & provide copies of the licensing report (LIC 809D/9099D) to parents/guardians of children in care at the facility by the close of business the following day or the next day child returns to the facility. The same report must be provided to parents/guardians of children newly enrolled at the facility during the next 12 months & licensee will obtain a signed Acknowledgement of Licensing Reports (LIC 9224) from parent/guardian & place it in each child's file.

Senate Bill 792: This bill, commencing September 1, 2016, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles

New Appeal Process: A licensee may file an appeal, in writing 15 business days from the date of receiving the penalty assessment. All appeals must be sent to: California Department of Social Services | Community Care Licensing Division| 300 N. Continental Blvd. Suite 290-A |El Segundo, CA 90245

Assembly Bill 1207: California Child Care Workers; Mandated Training Requirement. Beginning January 1, 2018, all licensed providers, applicants, directors and employees must complete Mandated Reported Training prior to March 30, 2018 and renew training every two years at: www.mandatedreporterca.com.
