During the interview with the Licensee, the Licensee stated that she was present during two of the incidents involving Child 1 sustaining bite marks from another child. The Licensee could not remember much of the details regarding the incidents other than stating one of the bite marks happened on the arm and the other on the leg of Child 1, during two separate occasions. The Licensee learned of the other two incidents from staff.
During the interview of staff, it was disclosed that Child 1 sustained 4 bite marks while under the care of Begum Family Child Care. Three of the bite marks resulted in Child 2 biting Child 1 during three separate occasions and the fourth incident involved Child 3 biting Child 1. The initial incident happened on 6/12/23 and the second incident happened on 6/28/23. Both incidents involved Child 2 biting Child 1 during a disagreement. The third incident happened on 8/1/23, as Child 3 was observed biting Child 1 during a disagreement. According to staff, during all three incidents staff were present but were unable to intervene as the incidents happened very fast. The fourth incident happened on 8/2/23, and again involved Child 2 biting Child 1, but nor staff or the Licensee had knowledge of the incident until it was brought to their attention by the mother of Child 1. After reviewing video surveillance, facility staff confirmed that the fourth incident also happened at the day care but staff did not witness the incident because they were busy assisting other children at the time. On 6/28/23, Child 1 also sustained a cut to the finger from playing with a broken toy. Based on the investigation conducted, there is sufficient evidence found to support the above-mentioned allegations to be true.
Based on LPA’s observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, (Title 22, Division & Chapter number), are being cited on the attached LIC 9099D.
A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of
the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form during this visit.
The Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Imtiaz Begum and Appeals Rights provided. |
