On 01/03/2022 at 8:10 a.m. Licensing Program Analysts (LPAs) Deborah Lowe met with applicant Tara Perera. LPA Suzette Ornelas arrived at 09:10 am. The purpose of the visit was an announce pre-licensing inspection at the facility due to a change in ownership to ensure that health, safety and personal rights as requires by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were no children were present during this inspection. This is an application for 27 children, ages 0 months to 2 years old. The child care center will operate Monday – Friday 7:00 a.m. – 6:00 p.m. The fire clearance was approved on 08/16/2021. Applicant has a pending application for a Preschool License #197494946.
LPAs Lowe and Ornelas toured and measured the on-limits areas and classrooms located at the facility. The facility has a total of 2 infant classrooms. Children will have access to 3 sinks.

Classroom measurements are:
· Infant Room #1= (28.58 x 15.17) = 433.56 + (5.25 x 6.58) = 34.55 – Encumbered space (3.92 x 2.42) = 9.49 – (2.50 x 6.0) = 15.
Total Infant Room: 433.56 + 34.55 – 9.49 – 15 = 443.62

· Toddler Room #2 = (24.50 x 18.92) = 463.54 + (3.58 x 6.92) = 24.77 – Encumbered space (2.50 x 6.0) = 15 Total Toddler Room: 463.54 + 24.77 – 15 = 473.31

Total Infant measurements: 443.62 + 473.31 = 916.93 divided by 35 sq feet = 26 Infants.
Outdoor Play measurements are:
Playground #1 = (78.33 x 39.67) = 3,107.35 divided by 75 sq feet = 41 Infant children.
Applicant is requesting a waiver for playground #1 to be a shared space for Infants and preschoolers ages 2 years -3 years of age.

Indoor/Children’s Area:
Indoor activity space for infants was observed to be physically separate from space used by children in the child care center and school-age child care center components.
All outdoor and indoor passageways, stairways, inclines, ramps, open porches and other areas of potential hazard were observed to be free of obstruction. The child care center was observed to be in need of cleaning. The child care center was observed with items in need of repair. LPAs advised the center shall be clean, safe, and sanitary at all times to ensure the safety and well-being of children, employees and visitors. Floors of all rooms have a surface that is in need of repair, floor tile was observed broken, missing. Carpet in the classroom was observed to be clean. A comfortable temperature for children was observed to be maintained at all times. The infant care center shall be equipped with appropriate furniture and equipment including, but not limited to, cribs, cots or mats; changing tables; and feeding chairs. Tables and chairs were observed to be meet the needs of the children. LPAs advised furniture shall be maintained in good repair and safe condition.

The type, height and size of furniture and equipment was observed to be age appropriate. LPAs advised swings, playpens and all such equipment and furniture shall be assembled or installed according to the manufacturer's instructions, and shall be maintained in good repair and safe condition. Toys shall be safe, and shall not have sharp points or edges or splinters, or be made of small parts that can be pulled off and swallowed. Rattles shall be large enough so that they cannot become lodged in an infant's throat and constructed so that they will not separate into small pieces.

LPAs observed that each child has an individual permanent or portable storage space for his/her clothing, personal belongings and/or bedding. All materials and surfaces accessible to children, including toys, shall be free of toxic substances.

Drinking water from a noncontaminating fixture or container was observed to be readily available both indoors and in the outdoor activity area. The licensee shall take measures to keep the center free of flies, other insects, and rodents. LPAs advised all containers used for storage of solid wastes, including moveable bins, shall have a tightfitting cover that is kept on; shall be in good repair; and shall be leakproof and rodent-proof. LPAs observed two trash cans with no lids. No fireplaces and open-faced heaters were observed. All window screens shall be in good repair and free of insects, dirt and debris.

Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children were observed to be stored where inaccessible to children. LPAs advised storage areas for poisons shall be locked. LPAs observed the following first-aid supplies in a location accessible to staff but inaccessible to children: LPA observed a current edition of a first-aid manual, sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution.

A center shall be equipped to isolate and care for any child who becomes ill during the day. Any infant in the isolation area shall be under constant visual observation by a director, an assistant director, a teacher or an aide. LPAs advised the isolation area shall be equipped with a crib, cot, mat or playpen for each ill infant. Facility was not observed with a crib or playpen for each ill infant in the isolation area. The isolation area shall not be located in the kitchen area or the general-use toilet area. Applicant stated isolation area will be in the directors office.

Child day care center was observed to have one or more carbon monoxide detectors in the facility. LPAs were able to hear a successful test. All child care centers shall have working telephone service on the premises.

In addition to the sign-in procedure requirement of Section 101226.1(b), the licensee shall develop, maintain, and implement a written procedure to sign the child in/out of the child care center that shall, at a minimum, include the following:
The licensee shall be responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted. Applicant stated health check is completed daily with temperature checks.

LPAs advised smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). LPAs advised a baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c).
There shall be at least 35 square feet of indoor activity space per child based on the total licensed capacity.

for each infant who is unable to climb out of a crib: Stacking wall cribs or cribs stacked one on top of another, often referred to as tiered cribs, shall not be permitted. LPAs advised cribs shall not limit the ability of staff to see the infant.

Crib mattresses shall be: Covered with vinyl or similar moisture-resistant material. Crib mattresses shall be:
Maintained in a safe condition with no exposed foam, batting or coils. Cribs were observed in need of repair. Crib room was observed to be crowed and organization of cribs to allow staff accessibility to each crib is needed.
Floor mats or cots that meet the requirements of Section 101239.1(b) shall be provided for all infants who have the ability to climb out of a crib. Each crib, mat or cot shall be occupied by only one infant at a time. Each infant's bedding shall be used for him/her only. Such bedding shall be replaced when wet or soiled,.
LPAs advised the calculation of indoor activity space for infants shall not include space designated and used for cribs.

The sleeping area for infants shall be physically separate from the indoor activity space.
LPAs advised cots used for napping shall be maintained in a safe condition. Constructed of foam at least 3/4 inch thick. Covered with vinyl or similar material that can be wiped. Marked or colored so that the sleeping side can be distinguished from the floor side. Wiped with a detergent/disinfectant weekly or when soiled or wet.

LPAs observed napping mats with exposed foam and are in need of repair or replaced. Each cot or mat shall be equipped with a sheet to cover the cot or mat and, depending on the weather, a sheet and/or blanket to cover the child. Applicant stated children will bring bedding from home and will be sent home weekly for washing.

LPAs reviewed Safe Sleep Regulations with applicant. LPAs provided applicant with Safe Sleep booklet, PIN 20-24 CCP, and LIC 9227 Individual Infant Sleeping Plan. LPAs observed an Infant sleep log in the infant classroom. The licensee shall provide a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities.

Infant Changing Tables
LPAs observed changing tables to have a padded surface no less than one-inch thick and be covered with washable vinyl or plastic with raised sides at least three inches high. LPAs observed to be be maintained in good repair and safe condition. While in use, be placed within arm's reach of a sink. LPAs advised changing tables shall not be located in the kitchen/food-preparation area. LPAs observed sink in room #1 near changing table to be full of toys with a dish drainer with infant dishes next to the sink that was observed next to the changing table.

Restrooms:
LPAs advised handwashing and bathing facilities shall be maintained in safe and sanitary operating condition. Infant room was observed with 1 staff bathroom only, no children’s bathroom was observed. Additional equipment, aids and/or conveniences shall be provided as needed in centers that serve children with physical disabilities.

LPAs advise hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C).
Notwithstanding (e) and (e)(1) above, handwashing fixtures shall not be required to deliver hot water.
There shall be one toilet and one handwashing fixture, separate from and in addition to the number of toilets and handwashing fixtures required in (h) above, designated for use by children who are ill, for use by staff, and for emergency use. This toilet and handwashing fixture shall be conveniently located in relation to the isolation area. Applicant stated the Isolation bathroom used by infants is located in the infant staff bathroom in room #1.

Common towels or washcloths are prohibited. There shall be a minimum of one hand washing sink to every 15 infants and one potty chair to every five infants being toilet trained. Toilets or potty chairs were not observed available for infants.

Outdoor:
LPAs advised outdoor activity space shall be physically separate from space used by children in the child care center and school-age child care center components. Applicant stated there is not a outdoor activity

area separate from space used by preschool children. Applicant is requesting an outdoor waiver for playground #1 to be a shared outdoor space.

LPAs observed a shaded rest area for the children. Outdoor play area was observed with hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. Plastic play equipment was observed with broken parts, sand bags observed on playground near trees were observed torn and shredding. As a condition of licensure, the areas around and under high climbing equipment, swings, slides and other similar equipment shall be cushioned with material that absorbs falls. No sandboxes were observed by LPAs.

The playground was observed to be enclosed by a fence to protect children and to keep them in the outdoor activity area. The fence shall be at least four feet high. Metal spring rider animal shape rider was observed to be not age appropriate for infants.

LPAs advise any construction or equipment that could pose a hazard in the outdoor activity area shall be made inaccessible to children in care. This shall include, but not be limited to, incinerators, air- conditioning equipment, water heaters, and fuse boxes.

No pools or bodies of water was observed within facility.
There shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity.

Health Related Services:
Medications shall be kept in a safe place inaccessible to children. Applicant stated medications will be stored in director’s office. A refrigerator shall be used to store any medication that requires refrigeration.
LPAs advise the licensee shall develop and implement a written plan to record the administration of prescription and nonprescription medications and to inform the child's authorized representative daily when such medications have been given. LPAs observed use of LIC 9221 Parent consent for administration of medication and medication chart.

shall complete a needs and services plan for the infant. Highchairs or other appropriate seating equipment shall be used to seat infants during feeding. LPAs advised Infants who are unable to sit unassisted in a high chair or other seating equipment shall be held by a staff person or other adult for feeding.

LPAs advise bottles, dishes and containers of food brought by the infant's authorized representative shall be labeled with the infant's name and the current date. The infant care center shall not serve honey or corn syrup to any infant.

LPAs advised all food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. All food shall be selected, stored, prepared and served in a safe and healthful manner.
All foods or beverages capable of supporting the rapid and progressive growth of microorganisms that can cause food infections or food intoxications shall be stored in covered containers at 45 degrees F (7.2 degrees C) or less.

LPAs advised pesticides and other similar toxic substances shall not be stored in food storerooms, kitchen areas, food-preparation areas, or areas where kitchen equipment or utensils are stored. LPAs observed pesticides sprays in the kitchen area located under the sink.
LPAs advised soaps, detergents, cleaning compounds or similar substances shall be stored in areas separate from food supplies.

All kitchen, food-preparation and storage areas shall be kept clean and free of litter and rubbish; and measures shall be taken to keep all such areas free of rodents and other vermin.
LPAs advised the food-preparation area shall not be used for: Children's play activities, unless such activities are part of a supervised food-education program. Full-day programs shall offer a midmorning and a midafternoon snack.

Full-day programs shall ensure that each child has a lunch. Half-day programs shall offer a midmorning or midafternoon snack.

Postings:
The license shall be posted in a prominent, publicly accessible location in the center.
LPAs observed a posted a copy of the LIC 613A (9/96), PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster in a prominent, publicly accessible area in the child care center at all times.

Menus were observed to be in writing and posted at least one week in advance in an area accessible for review by the child's authorized representative. LPAs advised copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request.

LPAs observed post signs at the entrance to the child care center that provide the telephone number of the local health department and information on child passenger restraint systems pursuant to Health and Safety Code section 1596.95(g) and Vehicle Code sections 27360 and 27360.5 FORM: LIC 610

LPAs advised each licensee shall have a disaster and mass casualty plan of action. The plan shall be in writing and shall be readily available. Contingency plans for action during fires, floods and earthquakes including, but not limited to, the following: FORM: LIC 9148. LPAs observed LIC 9148 posted in a prominent, publicly accessible area.

The following items were discussed:

Incidental Medical Services (IMS) policy was discussed. Regulation and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Mandated Reporter: Beginning on January 1, 2018, AB 1207, requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Volunteers are encouraged but not required to take the training.

Safe Sleep LPA discussed the safe sleep regulations with advised and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Senate Bill (SB) 792: This bill, commencing September 1, 2016, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles.

Senate Bill (SB) 277 New Immunization Requirement: Beginning January 1, 2016, personal beliefs exemptions will no longer be an option for the vaccines that are currently required for entry into child care or school in California. Personal beliefs exemptions already on file will remain valid until the child reaches the next immunization checkpoint.

The following corrections are needed before a licensure will be considered. Corrections are due by 01/18/2022:
  1. Deep cleaning to classrooms including tables and walls.
  2. Repair tile flooring in room 2.
  3. Remove indoor climber from room 2, observed to be for ages 2 years – 6 years old.
  4. Provide lids to two containers used for storage of solid waste in room 1.
  5. Remove pesticides from kitchen area, ensure poisons are locked and not stored in a kitchen area or food-preparation area.
  6. Provide disaster and mass casualty plan of action.
  7. Repair or replace cribs
  8. Organize crib room to ensure staff accessibility to all cribs.
  9. Ensure crib area is physically separate from indoor activity space
  10. Remove toys and infant dishes from changing table sink
  11. Provide a crib or playpen for isolation area.
  12. Secure shelving units to the wall.
  13. Remove or replace broken outdoor play equipment and torn sand backs from playground #1
  14. Remove metal spring rider animal shape riders from playground #1
  15. Provide updated facility sketch with room numbers and playground numbers.
  16. Provide safety outlet covers to exposed outlets.
  17. Make kitchen drawers and cabinets containing hazards and sharps inaccessible to children.
  18. Provide potty chairs for potty training infants.

An exit interview was conducted with the above items discussed and a copy of this report was provided to the Applicant Tara Perera. Final license determination will be made upon review by the Licensing Program Manager and correction of the above issues.
