On 01/28/2022 at 8:25 a.m. Licensing Program Analyst (LPA) Deborah Lowe met with applicants Arshaluys Indzhyan, Mariam Khachatryan, and Director Jessica Torres. The purpose of the visit was an announce pre-licensing inspection at the facility to ensure that health, safety and personal rights as requires by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There are 9 Infants present during this inspection. This is an application for a change of ownership for 16 infants, ages 0 months to 24 months. The child care center will operate Monday – Friday 7:00 a.m. – 6:00 p.m. The fire clearance was approved on 12/10/2021. Applicant has a pending applicant for a Preschool License 197494975.

LPA Lowe toured and measured the on-limit area and classroom located at the facility. The facility has a total of 1 infant classroom. Children will have access to 2 sinks, 1 toilets, and 1 changing table for infants.

Classroom measurements are:

· Infant Room = (14.33 x 23.05) = 330.31 + (12.42 x 8.58) = 106.56 + (10.92 x 7.67) = 83.76 + (10.83 x 8.17) = 88.48 – encumbered space (2.0 x 2.0) = 4

· Total Infant classroom activity space: 330.31 + 106.56 + 83.76 + 88.48 – 4 = 605.11 divided by 35 sq feet = 17 Infants.

Outdoor Play measurements are:

· Infant Outdoor Activity space: (20.58 x 19.50) = 401.31 + (8.0 x 21.42) = 171.36 + (11.25 x 25.67) = 288.79 + (8.67 x 46.0) = 398.82 + (19.25 x 49.42) = 951.34 + (50 x 10.67) = 533.50

· Total Infant outdoor space: 401.31 + 171.36 + 288.79 + 398.82 + 951.34 + 533.50 = 2, 745.12 divided by 75 sq feet = 36 Infants.

Indoor/Children’s Area:

Indoor activity space for infants was observed to be physically separate from space used by children in the child care center component.

All outdoor and indoor passageways, stairways, inclines, ramps, open porches and other areas of potential hazard were observed to be free of obstruction. The child care center was observed be clean, safe, sanitary and in good repair to ensure the safety and well-being of children, employees and visitors. Floors in the infant room was observed to have a surface that is safe and clean. A comfortable temperature for was observed. The infant care center was observed to be equipped with appropriate furniture and equipment including, including, cribs, cots; changing table; and feeding chairs. Tables and chairs were observed to be meet the needs of the children. Furniture was observed to be maintained in good repair and safe condition.

The type, height and size of furniture and equipment was observed to be age appropriate. LPA advised swings, playpens and all such equipment and furniture shall be assembled or installed according to the manufacturer's instructions, and shall be maintained in good repair and safe condition. Toys were observed to be safe, and did not have sharp points or edges or splinters, or be made of small parts that can be pulled off and swallowed. LPA advised rattles shall be large enough so that they cannot become lodged in an infant's throat and constructed so that they will not separate into small pieces.

LPA observed individual storage space for children's' clothing, personal belongings and/or bedding. All materials and surfaces accessible to children, including toys, were observed to be free of toxic substances.

Drinking water from a noncontaminating fixture or container was observed to be readily available both indoors and in the outdoor activity area. Applicants stated they have a monthly pest control service. All containers used for storage of solid wastes, including moveable bins, were observed to have a tightfitting cover that is kept on; in good repair; leakproof and rodent-proof. No Fireplaces or open-faced heaters were observed in the Infant room. One window screen was observed to be in need of repair.

LPA advised disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. No poisons were observed. LPA advised storage areas for poisons shall be locked. The licensee shall maintain the following first-aid supplies in a location accessible to staff but inaccessible to children: LPA observed a current edition of a first-aid manual,

sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution.

A center shall be equipped to isolate and care for any child who becomes ill during the day. Any infant in the isolation area shall be under constant visual observation by a director, an assistant director, a teacher or an aide. LPA advised the isolation area shall not be located in the kitchen area or the general-use toilet area. Director stated currently isolation area is in the classroom, infant is isolated with use of playpen and under direct supervision of the director.

LPA observed one or more carbon monoxide detectors in the facility. LPA Lowe was able to hear a successful test. Child care centers was observed to have working telephone service on the premises.

In addition to the sign-in procedure requirement of Section 101226.1(b), the licensee shall develop, maintain, and implement a written procedure to sign the child in/out of the child care center that shall, at a minimum, include the following: Director stated wellness checks are completed daily at drop off to ensure that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted.

LPA advised smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). A baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c).

Napping:

LPA Lowe observed a standard size crib meeting the following requirements was observed to be provided for each infant who is unable to climb out of a crib. Cribs shall not limit the ability of staff to see the infant. Crib mattresses were observed to be covered with vinyl or similar moisture-resistant material and maintained in a safe condition with no exposed foam, batting or coils.

Each crib, mat or cot shall be occupied by only one infant at a time. LPA advised each infant's bedding shall be used for him/her only. Such bedding shall be replaced when wet or soiled, or when the crib, mat or cot is to be occupied by another infant.

LPA advised the calculation of indoor activity space for infants shall not include space designated and used for cribs. LPA observed the sleeping area for infants observed be physically separate from the indoor activity space.

LPA observed a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities.

Infant Changing Tables

LPA Lowe observed changing table to have a padded surface no less than one-inch thick and be covered with washable vinyl or plastic. Changing table has raised sides at least three inches high. Observed to be maintained in good repair and safe condition. While in use, be placed within arm's reach of a sink. LPA advised changing tables shall not be located in the kitchen/food-preparation area.

Restrooms:

All toilets, handwashing and bathing facilities shall be maintained in safe and sanitary operating condition. Additional equipment, aids and/or conveniences shall be provided as needed in centers that serve children with physical disabilities.

Hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C).

Notwithstanding (e) and (e)(1) above, handwashing fixtures shall not be required to deliver hot water.

Common towels or washcloths are prohibited. There shall be a minimum of one hand washing sink to every 15 infants and one potty chair to every five infants being toilet trained.

Outdoor:

Outdoor activity space shall be physically separate from space used by children in the child care center and child care center components.

LPA observed a shaded rest area for the children. LPA advised outdoor area shall be free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. As a condition of licensure, the areas around and

under high climbing equipment, swings, slides and other similar equipment shall be cushioned with material that absorbs falls.

The playground shall be enclosed by a fence to protect children and to keep them in the outdoor activity area. LPA observed the fence around the Infant play yard to measure 3 feet 2 inches. LPA advised the fence shall be at least four feet high. Metal fence near tree area was observed to be in need of repair.

LPA advised any construction or equipment that could pose a hazard in the outdoor activity area shall be made inaccessible to children in care. This shall include, but not be limited to, incinerators, air- conditioning equipment, water heaters, and fuse boxes.

Little Tikes play equipment on infant playground was observed with an age requirement of ages 2 years – 5 years-old. LPA advised all play equipment needs to be age-appropriate for the ages of the children.

No pools or bodies of water was observed at facility.

There shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity.

Health Related Services:

Medications were observed to be kept in a safe place inaccessible to children. A refrigerator is available be used to store any medication that requires refrigeration.

The Director provided a written plan to record the administration of prescription and nonprescription medications and to inform the child's authorized representative daily when such medications have been given.

Food Service:

Prior to the infant's first day at the center, the infant care center director or assistant director shall complete a needs and services plan for the infant. LPA reviewed needs and service plan with Director. LPA observed high chairs used to seat infants during feeding. LPA advised Infants who are unable to sit unassisted in a high chair or other seating equipment shall be held by a staff person or other adult for feeding.

LPA advised bottles, dishes and containers of food brought by the infant's authorized representative shall be labeled with the infant's name and the current date. The infant care center shall not serve honey or corn syrup to any infant.

LPA advised all foods or beverages capable of supporting the rapid and progressive growth of microorganisms that can cause food infections or food intoxications shall be stored in covered containers at 45 degrees F (7.2 degrees C) or less. Refrigerator was observed without a thermometer.

LPA did not observe any pesticides or other toxic substances. LPA advised pesticides and other similar toxic substances shall not be stored in food storerooms, kitchen areas, food-preparation areas, or areas where kitchen equipment or utensils are stored.

Soaps, detergents, cleaning compounds or similar substances shall be stored in areas separate from food supplies.

The food-preparation area shall not be used for: Children's play activities, unless such activities are part of a supervised food-education program. Full-day programs shall offer a midmorning and a midafternoon snack.

Full-day programs shall ensure that each child has a lunch.

Postings:

The license shall be posted in a prominent, publicly accessible location in the center.

The center shall post a copy of the LIC 613A (9/96), PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster, LIC 610 Emergency Disaster Plan, and LIC 9148 Earthquake Preparedness Checklist in a prominent, publicly accessible area in the center.

Menus shall be in writing and shall be posted at least one week in advance in an area accessible for review by the child's authorized representative. Copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request.

The licensee shall post signs at the entrance to the child care center that provide the telephone number of the local health department and information on child passenger restraint systems pursuant to Health and Safety Code section 1596.95(g) and Vehicle Code sections 27360 and 27360.5

Applicant was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA reviewed with applicant the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform.

An exit interview was conducted with the above items discussed and a copy of this report was provided to the Arshaluys Indzhyan, Mariam Khachatryan, and Director Jessica Torres. Applicant Mariam Khachatryan signed LIC 809. Final license determination will be made upon review by the Licensing Program Manager and correction of the above issues.
