25 | On October 23, 2020 Licensing Program Analyst (LPA) Monique Ayala and Licensing Program Manager (LPM) Mariela Ramon conducted a case management inspection for the purpose of inspecting the back yard.
The purpose of the visit is to observe how the rear yard is going to become inaccessible to children in care due to an in ground swimming pool being built. Upon arrival LPA and LPM were greeted by licensee. LPA and LPM observed 3 infants and 1 toddler in care.
During the visit, LPA and LPM toured the facility and took photographs of the rear yard and side fence that gives access to the rear yard. The day care area is located in a converted garage that is now another room with all permits from the Department of Building and Safety, where there is walking path that leads to the rear yard. Prior to entering the rear yard, there is a wooden gate that remains closed. The wooden gate is 5 feet and 58 inches tall. The wooden gate has a safety latch at the top of the gate that is inaccessible to a child.
Licensee stated that she will install a mesh fence that will surround the in ground swimming pool. The pool fence will meet Title 22 Regulations. LPA and LPM discussed body of water regulations. Title 22 regulation 102417(g)(5)(A): All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence.Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use. |
