On May 20, 2022 at 9:04AM, Licensing Program Analyst (LPA) Brigitte Tsutaoka conducted an unannounced annual/random inspection. LPA disclosed the purpose of inspection and was granted entry by Director, Loannie Ramirez who guided LPA on a tour of the facility. At 11:30AM, Licensee Yesenia Canchola arrived at the facility. Upon arrival LPA observed two classrooms in use with a total of 11 preschool children and 3 staff (on association list) on the premises. The hours of operation are 6:30am - 6:00 pm Monday - Friday. The center also has an Infant Program (#197750052). Incidental Medical Services (IMS) were discussed.

Furniture and equipment were inspected for age appropriateness and good repair. All rooms are clean and safe. Telephone service was verified. Heating, lighting, and ventilation are adequate. There are cubbies for children's belongings. LPA observed age appropriate toys and materials. Drinking water is available inside the classrooms in the form of disposable cups and water pitcher. LPA observed a sufficient quantity of cots available for napping children. The bedding is stored separately and properly. The sheets and blankets are washed (weekly or as needed) and cots are sanitized daily. There is a fire extinguisher (serviced 3/2022), smoke detector and a carbon monoxide detector on the premises. Facility has central fire alarm system located outside pre-k classroom.

LPA inspected and observed one clean bathroom (4 toilets, 3 sinks). Toilets and sinks are functioning properly and are age appropriate. LPA observed soap, toilet paper and paper towels readily available. Water temperature is appropriate. LPA observed staff conducting a restroom break. Upon inspection of the staff bathroom, LPA observed a bottle of Ortho Home Defense Max Pesticide located in inaccessible staff restroom not secured/locked.

Children are inspected for illnesses as they arrive. A review of medication policy indicated that prescription medication is administered only with parent's written permission. Medication is brought and locked at the center (unless parent request daily return). Medication is properly labeled and stored in its original container. Medication is kept at the center until expiration date (given to parent or discarded through the Fire Department). LPA observed expired inhaler in emergency bag located in classroom. Licensee removed during inspection and agreed to return to parent. Licensee stated child has not used medication in quite some time.

Outdoor play equipment was inspected for health, safety, cushioning material, good repair and age appropriateness. The play area has sand and concrete. There is an area for rest. Shade is available under play structure. Canopy over play yard blew off and became tattered due to wind. Licensee stated she has replaced canopy multiple times and intends to renovate shaded area to have more secure/permanent structure in it's place. Water pitcher and disposable cups brought outside during play. Play area was inspected and found to be free of hazards and inaccessibility to bodies of water. Separate playground schedule for infant and preschool children. Swing and jungle gym are anchored. Age appropriate outdoor toys in good repair are available to children for play.

There is a clean kitchen (off limits) with refrigerator and microwave oven. The facility provides breakfast, lunch, snacks (afternoon, evening). Allergy lists are posted in kitchen and classrooms. LPA observed an appropriate amount of food and snacks, staff preparing lunch (with gloves). The chemicals are kept separate from the food (off-limits staff restroom).

Sign in and out sheets procedures were reviewed. The facility uses Brightwheel as the method if signing in/out children and a primary platform of parent/staff communication. The parent board was reviewed and is missing the emergency disaster plan. LPA observed copy in facility file. Licensee provided a written Emergency Disaster Plan (Not on LIC610), which did not stipulate how children will be transported or who will transport them in the case of an emergency. Fire/earthquake drills current. Roster current.

Teacher child ratios were observed and staff names recorded. Care and supervision was evaluated to determine if the basic needs of children are met and appropriate. Personal rights of children were discussed.

Children's records and staff records were reviewed. During file review, LPA observed staff files of staff present at the center. LPA observed staff files were missing the Health Screening (LIC503), the Criminal Record Statement (LIC508), and proof of required immunizations (MMR, DTap, and Influenza). LPA also observed expired Mandate Reporter Training certificates in the staff files. The Director's file was missing proof of Preventative Health and Safety Training. Staff are certified in CPR/First Aid expire 11/14/2022. During file review of child files, LPA observed 10 child files. One file was missing the Physician Report while files had incomplete Physician Reports without the TB Screening completed by a physician. Additionally, one file was missing the immunization record.

Licensee was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
