32 | LPA advised the licensee to access forms, regulations and quarterly updates on the Child Care Licensing website at: www.ccld.ca.gov.
Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
LPA observed school age children (Kindergarten) that are a part of the elementary school using licensed classrooms. Room 2: 17 children with 2 staff and Room 3: 17 children with 3 staff. LPA asked director if any forms were submitted to the department indicating that change (waiver request or capacity decrease request). Director stated she was unsure and needed to contact the principle. LPA informed director that while Room 2 and 3 are licensed under the department, they are not to be used by school age children. LPA informed the director that if the facility wants to use those classrooms as Kindergarten classrooms, the facility can apply for a waiver or the facility can submit an application to reduce the capacity and classrooms. LPA informed director that the licensed rooms 2 and 3 must be vacant until the capacity decrease has been complete or the waiver has been approved. LPA informed that a waiver is not always guaranteed
The facility is licensed for 45 children, based on LPAs observation the facility had 46 children present today 11/08/2022 in the licensed classrooms (room 1, room 2 and room 3). The facility is operating out of limitations. A technical violation is being submitted. A Declaration was provided to LPA stating that children will be removed from licensed classrooms.
Based on the LPA’s observations and records reviews, the following deficiencies listed on the attached LIC 809D (deficiency page) and the following technical violation is being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.
