Licensing Program Analyst (LPA) Nolan Tcheng conducted an unannounced inspection for the purpose of delivering complaint findings. Upon arrival at 11:17am, LPA was greeted by Director Niloufer Pieris to whom the purpose of the inspection was explained. At 11:25am, LPA given a tour of the facility where there were children present at the time of inspection.

Census was taken. Toddler Room had 14 children with 3 staff members, and Preschool room had 24 children with 3 staff members

During the course of the investigation, interviews were conducted with six staff, eleven children, and seven parents. Child file review was conducted on five files. LPA obtained documentation in the form of Child Care Facility Roster, Class attendance, Injury report form, parent handbook, and copy of employee handbook.

Licensing Program Analyst (LPA) Nolan Tcheng conducted an unannounced inspection for the purpose of delivering complaint findings. Upon arrival at 11:17am, LPAs was greeted by Director Niloufer Pieris to whom the purpose of the inspection was explained. Information from the complainant indicates that the facility is commingling children between their Preschool room and their toddler room.

During parent interviews, Parent #2 states that their child would move from room to room during the day. They stated that “academic is 9am-3pm and after hours they go to the Toddler room.” Parent #4 states that sometimes their child will come from the toddler room because “they start putting them all in one room.” Parent #7 stated that their child is mainly in the big room and then moves to the smaller room for after school, 3-5pm.

Discussion with Director, notes that they were under impression that the first and the last hour of the day could be combined. LPA discussed the regulations indicating that preschool age children and toddler (infant) age children must remain separated.

Information by multiple parent interviews indicate that the children in preschool room have been going to the Toddler room.

Based on LPAs observations and interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 Chapter 1 Preschool Program With Toddler Component 101216.4, is being cited on the attached deficiencies page.

Upon receipt of this report, the Licensee shall post the Notice of Site visit and any licensing report documenting a type “A” deficiency. The report and the Notice of Site visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative.

Exit interview was conducted with Director Niloufer Pieris at 12:25pm. Copy of report provided.

Information from the complainant indicates that staff hit the daycare children, intimidate daycare children, spoke inappropriately to a daycare child, spoke inappropriately in front of a daycare children, and are humiliating children in care. Facility is also allegedly not providing first aid to children and not reporting it unusual incident to parent.

LPA interviewed director during inspection on 11/16/2022. Director states that the facility discipline policy is to use two minutes on the carpet for preschool and one minute for the Toddler class. Staff were disclosed as using a “loud voice but that is it.” Injuries are usually logged and parents are called if needed for urgency. When parents pick up the child, a copy of the injury log goes with the parent and one stays to go in file. During the interview with director, no disclosures were made regarding the allegations.

Staff interviews were conducted on 11/16/2022 and 12/08/2022. Discipline policy was discussed with all staff, and all interviews note that they speak with children and talk to them regarding the situation. Staff all disclosed that injury reports are used for children and that they do provide first aid and that all injuries are disclosed to parents. No disclosures were made regarding other allegations.

Children made no disclosures regarding the allegations.

Parent interviews made no disclosures regarding the allegations.

Based upon the evidence as presented above, this agency has investigated the allegation above and has determined that the allegations are Unsubstantiated. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

No deficiencies are being cited for the allegations listed above
