On 04/19/2023 at 9:00 am, Licensing Program Analyst (LPA) Roxana Lopez conducted an unannounced required inspection. A risk assessment was conducted prior to entering the facility. LPA met with Teacher Ruby Chavez, who led LPA into the facility. Licensee Esther Szeto arrived at 9:25 am and guided the LPA on a tour of the facility. This is a preschool age program licensed for 50 children which operates Monday – Friday from 7:30 AM – 6:00 PM. Per the Licensee there are 33 children enrolled. There was a current roster available for review.

All areas identified on the Facility Sketch were inspected. The following staff was present during this inspection: Classroom # 1 (older preschoolers): Staff #1 with 10 children, Classroom # 2 (younger preschoolers) with Staff # 2 and Staff # 3 with 9 children. Teacher-child ratios were observed to be in accordance with Title 22 Regulations. Staff names were recorded. All children were observed to be under supervision, including visual supervision, of a teacher at all times. The licensed facility is within the conditions, limitations, and capacity specified on the license.
LPA observed the facility to be clean, sanitary and in good repair. Furniture and equipment was inspected for good repair, free of sharp, loose, or pointed parts. All indoor classrooms were inspected to ensure that the floors have a surface that is safe and clean. All materials and surfaces accessible to children are toxic free. At this time, the office is used as an isolation area. Parents are contacted immediately when children are determined to be ill and staff are ensuring that children with obvious symptoms of illness are not being accepted.

At 9:20 am LPA observed a mopping bucket with a mop and approximately 3-4 inches of water in the children's bathroom in classroom # 2. Bucket was emptied out during inspection. ------ pg. 1 of 4 ---

All toilets and washing facilities are in safe and sanitary operating conditions

Snack menus were reviewed to ensure that they are being posted at least one week in advance and visible to an authorized representative. The facility provides AM snack, lunch and PM snack. All kitchen, food preparation, and storage areas are clean, free of litter, rubbish, and rodents/vermin. All food is protected from contamination, and LPA inspected that any contaminated food is discarded immediately.

There is drinking water available in all indoor classrooms via water bottles brought from home and water is available for refill if needed. All storage containers for solid waste, including moveable bins, have tight fitting covers on and are in good repair.
Disinfectants, cleaning solutions, poisons and other items that are dangerous to children are stored in an area inaccessible to children. Licensee states that there are no poisons stored at the facility.
LPA observed that there is smoke and carbon detectors in the facility and were found operable. Last drill conducted was on 3/17/2023.

LPA observed the playground structure to be made out of wood, some areas of the structure has been weathered with the rain. LPA advised licensee to check the structure throughout for any splinters and have it sand down. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. All areas around or under high climbing equipment, swings, slides, and similar equipment are cushioned with material that absorbs a fall. There is adequate shade in the play yard. Children bring their own personal water bottles outside with them.

Sign in and out sheets were reviewed to ensure that the person who signs the child in and out uses their full legal signature and records the time of the day.

At 9:40 am LPA discussed the Lead Testing requirement with Licensee- as the department has not received any lead testing results and Licensee has not submitted any ------- pg. 2 of 4-------------------

paperwork to the department. Per Licensee, they had lead testing done 10 years ago. Staff Records were reviewed to ensure that a health screening report is on file. Children’s Records were reviewed to ensure that Identification and Emergency form and a medical assessment are on file. Criminal Records Clearance for adults and verification of CPR/First Aid and health preventative practices documentation was reviewed.

LPA issued the Review of Children's Records (LIC 857) and Review of Staff’s Records (LIC 859) to the facility representative during this inspection. The LIC 857 documents the children’s files that were reviewed and the LIC 859 documents staff’s file reviewed. during this inspection.

SB792 (Immunization Requirements for Staff and Employees) was discussed with the Licensee. LPA observed that Licensee did not have proof of immunizations.

AB1207 Mandated Child Abuse Reporting – On or before March 30, 2018 any person who works in a child care facility shall complete the training and renew the training every 2 years. Website provided: https://www.mandatedreporterca.com/training/child-care-providers.

At 10:30 am LPA observed that Staff # 1, 2, 4 & 5 did not have a current AB1207 Mandated Reporter Certificate on file.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. LPA advised the licensee to access forms, regulations and quarterly updates on the Child Care Licensing website at: www.ccld.ca.gov.
Licensee was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Based on the LPA’s observations and records reviews, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code od Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
