Licensing Program Analysts (LPAs) Cynthia Reyes and Steven Rodriguez conducted a follow up Inspection to present the findings of the complaint investigation. LPAs Reyes and Rodriguez identified themselves and discussed the purpose of the inspection. During the inspection, Amanda Sanchez, Director took LPAs on a tour of the facility indoors and out and LPAs were able to observe and collect the census of staff (2) and children (21) currently present at the facility on this date.

LPAs conducted Interviews, and records were received and reviewed. The allegation regarding reporting requirements and staff do not treat daycare child with respect, was regarding parents fought in front of children while in the day care is substantiated. Per interviews conducted two parents were arguing and fighting because of a parking incident between them in the parking lot. The altercation was in the front lobby of the school, which is surrounded by 3 class rooms with children present and a hall way leading to other class rooms with children and with both the parents children present in the lobby and one of the parents child was repeating what his mother was yelling to the other parent. Both parents were yelling, and one parent swung at the other parents

face and kicked her on the leg. Staff stated they did not report this incident to the department because they stated they have never gone through that before and they didn't know to report it to the department.

The allegation regarding Staff failed to provide transportation for day care child is substantiated. A child was supposed to be picked up from her private school and per interviews conducted it was stated that the bus driver could not leave the parking lot because a car stalled at the entrance. Staff stated he waited to see if the car would be able to move and after a while when he noticed it was not able to move he then finally called the assistant director to inform her that he was going to be late picking up the child. Staff stated they tried to get a hold of the parent and were not able to. By the time the driver got to the private school, the child had already been picked up by her grandmother due to the private school calling the mom and stated, the child had not been picked up by the day care and they had been more than 20 minutes late. Per parent she stated the day care never notified her they were going to be late picking up her daughter. Per assistant Director stated she did not know she was supposed to report this incident to the license department because she had finally got a hold of the parent.

This agency has investigated the complaint alleging, Staff failed to provide transportation for day care child, Staff do not treat day-care child with respect-- parents fought in front of children and reporting requirements. Based upon the evidence as listed above, the preponderance of evidence standard has been met, Therefore the allegations have been determined to be Substantiated. California Code of Regulations, Title 22, and Health and safety are being cited on the attached LIC 9099D.

A copy of this report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the next 12 months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent. LPA provided Amanda Sanchez with a blank copy of the LIC 9224 Acknowledgement of Receipt of Licensing Report.

The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
Exit interview was conducted with Director, Including, but not limited to Provider Rights, Appeal Procedures and Agencies Consultative Role. The Director’s signature on this report also acknowledges receipt of rights.
