Licensing Program Analyst (LPA) Seung Lee conducted an unannounced complaint inspection. Upon arrival LPA Lee met with Director Margie Zarate.

During the course of this inspection, LPA conducted interviews, reviewed documents, and made observations in regards to the above allegation.

The complaint alleges that staff members in the infant program are not providing enough supervision in the classroom which resulted in Child#1 sustaining injuries. The facility denied this allegation and made no disclosure. LPA Lee observed various incident reports for Child#1 during file review. The staff members who were associated with the incident reports were interviewed during this inspection. LPA observed that the details in the incident reports were specific and matched up with the recollections provided by the staff members during interviews.

During interviews, facility staff stated that children in infant room A are learning how to walk and crawl around in the classroom which does cause incidents involving an infant bumping their head or falling while trying to stand and balance themselves. It was also stated that infants in room A are teething which results in incidents where one child bites another child. The last incident involving Child#1 stated that Child#1 was bitten by another child, when Child#1 attempted to take a toy from the other child. The staff members that observed and documented this incident stated that Child#1 was already separated from the other child before the biting. The staff stated they separated Child#1, went to go rinse a bottle in the sink, and observed Child#1 go up to the other child again which resulted in the bitting.

It is possible that a child in care can sustain an injury from an interaction with another child or by themselves despite being provided adequate supervision. Even if a teacher was providing supervision, a child cannot be physically restrained by a staff or by a device while engaging in indoor activities due to the personal rights of a child. Therefore, it is possible that Child#1 sustained the injuries in the classroom despite the staff providing the adequate amount of supervision. However, it is also possible that Child#1's sustained injuries were caused by lack of adequate supervision from the staff. For example, if 1 infant staff member is changing a child or using the sink, than the other staff member should refrain from doing a similar activity until the first staff member is finished.

Based on the evidence collected during the investigation, the allegations that Staff did not prevent infants from sustaining injuries due to lack of supervision may be valid. However, there is not enough preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegations are found to be unsubstantiated.

The notice of site inspection must remain posted for a period of 30 days during hours operation. Failure to maintain posting will result in a civil penalty of $100.00 dollars.
