An unannounced Complaint Investigation was conducted on this day by Licensing Program Analyst (LPA) A. Lucero regarding the allegations above. LPA met with Director Mary Nichols.

Upon LPA's arrival, there were a total of four infants in Nursery Room 1 with two staff, eight infants and two staff in Nursery Room 2, and 10 toddlers with three staff in Toddler Room. Per Director, infants in Nursery Room 1 are typically 12 months and younger, and infants in Nursery Room 2 are typically 12 - 19 months of age. Children in care are too young to interview.

Complaint alleges staff are not following the food menu and staff are not providing water to day care children. Interview was conducted with Director and staff who deny allegations. Upon initial arrival into facility, and before a tour of the facility, LPA observed the "Look What's Cooking" board with a post-it indicating a meal substitution for the morning snack on 02/13/2020.

During interviews with Director and staff, it was stated that any meal substitutions are posted on the Look What's Cooking board posted in the main hallway for all parents to see. Staff stated that the Look What's Cooking board has been in place for more than 10 years to notify parents of any meal changes; it is the parents' discretion to view the Look What's Cooking board upon entering or exiting the facility. It was also stated that the post-it with meal substitution is taken down the next day.

It was also stated during interviews that parents receive a status of their child's day, along with what their child ate for the day. Director stated that parents are notified in the Kindercare app of what their child ate for that meal. Director and staff also stated that children are offered food, but do not force children to eat what they do not want to eat.

Regarding the allegation that staff are not providing water to day care children, interviews were conducted with Director and staff who deny allegation. LPA observed drinking fountains in the classroom, and water cups with children's names on them. It was stated that in the event a child does not have a water cup, one is provided to them by the facility. LPA obtained a photo of freshly washed water cups in a drying rack ready to be used in case a child came in without a water cup. LPA obtained photo of water cups within arms reach in children's cubbies with names on them. LPA also obtained photo of drinking fountains in classrooms.

Due to conflicting information received, LPA is unable to determine if staff are not following the food menu and staff are not providing water to day care children. Although the above allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore at this time the above allegations are Unsubstantiated.

The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

Exit interview conducted with the Licensee, during which appeal rights were given and explained. A copy of the Appeal Rights (LIC 9058 01/16) was provided. The Licensee’s signature on this report acknowledges receipt of rights.
