Licensing Program Analyst (LPA) Veronica Martinez Garza conducted an unannounced complaint investigation for the above allegation at the above facility on 04/24/23 at 08:25AM. A COVID risk assessment was conducted upon entry- appropriate PPE was used. LPA met with Assistant Director, Angie Haili, who guided LPA on a tour of the facility. Director Melissa Garcia later arrived at 9:00AM. A census of children and staff was taken of Room Infant A room, Infant B room, and Toddler room prior to the tour. There was a total of 27 children present.

During the inspection LPA observed 8 infants in the Infant A room with 2 Staff; 8 infants in Infant B room with 2 Staff; 11 toddlers in the Toddler room with 3 Staff.

Day care is out of ratio- Complainant alleged that day care staff is left alone to supervise 10 infants. During the initial walk through on 04/24/23, LPA observed Staff 5 (S5) and S6 providing care and supervision to 8 infants in the Toddler room. According to Director, S5 is the child care center cook. A review of children’s sign in for the week of 04/17-04/21 found that S5 also provides supervision in other infant rooms as well. After S5 and S6 file reviews, LPA determined both staff were hired as aides. Per S6, staff was enrolled to take core units, however, based on email confirmation, S6 has been enrolled since December 2021. S6 did not complete courses in 2021 or 2022. S6 stated new enrollment of core units as of April 2023, however, S6 never took the courses and doesn't plan on taking these courses. Though LPA can not confirm enrollment of core units, staff are required to be enrolled on a consecutive basis.

Based on LPA observations and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiency are being cited (see attached 9099D).

Upon receipt, the Licensee shall post the “D” page of the Licensing report. This page shall be posted for 30 consecutive days. Failure to maintain posting as required will result in a $100 civil penalty. A copy of this report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the next 12 months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent. LPA provided Licensee with a blank copy of the LIC 9224 Acknowledgement of Receipt of Licensing Report.

Exit interview was conducted with Director, Melissa Garcia, who was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these forms.

Per Director, Facility is in the process of hiring additional staff. Assistant Director and Director will ensure that they continue to provide coverage to meet ratios. Director shall submit a detailed staff schedule outlining staff room assignments and coverage. Director will provide a copy of the sign-in sheet by the POC due date 06/26/23
