Visit conducted in Spanish

On 4/26/2024 at 10:23 am, Licensing Program Analyst (LPA), Carolyn Tuba conducted an unannounced inspection visit for the above facility. Covid risk assessment was conducted. LPA met with Licensee, Maria Enciso. During today’s inspection LPA observed 3 children in care with an additional adult assistant. A facility roster was available. Per Licensee, operating hours are from Sunday – Saturday 3:30 am – 10:00 pm and cares for children ages Birth to 13 years of age. Licensee provides transportation services from school for school-age children. The licensee provides breakfast, AM/PM snacks, lunch, and dinner to the children in care. Licensee provides all meals and is not part of a food program. The facility is currently a large family childcare.

This is a one-story single-family house which consists of a living room, kitchen, kitchenette (eating area), garage, front yard, side yard, back patio, playroom, 3 bedrooms and 3 bathrooms. Areas used by children were inspected as follows: Living room, kitchen, kitchenette (eating area), playroom, 1-bathroom, front yard, and back patio.

Areas off limits include: 3 bedrooms, 2 bathrooms, side yard and garage.

The licensee states that 2 adults currently are living in the home and no minor children.

There is a in ground swimming pool in the back yard. A iron rod gate creates a barrier and gate was observed to have a chain link and padlock and LPA observed that gate self-closes.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Safe sleep was discussed on a previous visit of 4/8/2024 and Safe Sleep documentation was provided. Licensee currently has two (2) children that qualify as infant (24 months).

The licensee and other personnel have completed training on preventive health practices including Pediatric First Aid and CPR, which includes the EMSA Sticker which expires on 5/2025 (Licensee) and 9/2025 (Assistant). LPA observed first aid supplies are available. Licensee’s Mandated Reporting Training Certificate AB 1207 expires on 4/2025 and her Assistant expires on 3/2026. LPA advised that all persons working with children require the Mandated Reporting training. The following link http://www.mandatedreporterca.com/ was provided.

Currently, children are using the back patio and the front yard for outdoor play time. The front yard has a play structure and a dome shape climber play contraption made from metal. LPA advised Licensee that dome shape climber needs to be checked for repair. Front yard is enclosed by an iron gate and back patio has a cement wall and iron gate enclosing the areas.

The licensee is observed to be operating within the license capacity limitations. LPA did not observe any children left in parked vehicles. Car seats shall only be used for transportation. LPA did not observe any children sleeping in car seats. The Licensee was reminded to utilize play yards, cribs, and highchairs for what they are intended for and not leave children in them for any other reason.

Children and Staff must be maintained and updated as needed and must be available for review by the Department. If Children and Staff leave the day care all records must be maintained for 3 years after leaving. LPA observed that children’s files had the following documents of the LIC 700, LIC 627 and LIC 995A available.

LPA filled out the Bodies of Water Checklist and pool requirements were met; however the LPA observed the self-latch was installed 26 inches below the top of the gate, which does not meet the bodies of water regulation requirements. Licensee submitted a declaration that children are supervised and there is an alarm on the sliding glass door and observed to be operating. LPA has requested that latch be installed at least six inches from the top. Licensee stated that she will continue to use the padlock and chain link to lock the gate. Per Licensee the children do not use the swimming pool during the hours of operation.

Licensee states that there are no firearms stored in the home. The home was inspected for safety, comfort, cleanliness, ventilation, and telephone service. LPA advised Licensee that the kitchen area is unkempt, play room has shelves that are stuffed with learning materials and in front of the fireplace paperwork and materials require organization, as they may impend pathways may fall onto younger children. LPA took photos.

Fire and safety drills must be performed every 6 months and documented for review by the Department. Licensee conducted Emergency Drill on March 2024, and documented. No one smokes at the family childcare home. There is currently a fireplace, but it is locked with an iron gate and per Licensee it is not being used. There is shelf that obstructs the access to the fireplace.

In the absence of the licensee a qualified adult must be present supervising the children; a qualified adult is an individual who has a valid and current Pediatric First Aid and CPR training, Immunization's (TDAP, MMR, Influenza), mandated reporter training and a valid criminal record clearance associated to the facility license.

Detergents, cleaning compounds, medications, and other items, which could pose a danger, were determined to be inaccessible to children in care during this inspection. Medication is kept in Licensee’s bedroom and on the top cabinet of the kitchen along with kitchen knives. Cleaning supplies are kept under the kitchen sink with a child proof lock.

LPA observed the required 2:A-10:B-C fire extinguisher and per Licensee it was last serviced June 9, 2023. State Fire Marshall standards, fire extinguisher shall be service annually. LPA reminded Licensee that she will need to service fire extinguisher in June of 2024. The smoke detector and carbon monoxide detector were tested and working properly. Facility currently does not have any pets and LPA did not observe any during the visit.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA provided Safe Sleep documentation both in Spanish and English for both licensees.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: https://www.ada.gov/resources/child-care-centers/. There are no children currently taking medication.

Licensees was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.
