An unannounced follow up Complaint inspection was conducted on today's date by Licensing Program Analyst (LPA) Emiko Bell. Today's inspection was conducted in order to present the findings of the complaint investigation.

Upon arrival, walked to the pre-school where LPA was greeted by Executive Preschool Director Christi Navarrett, to whom the reason for the inspection was announced and who then guided LPA to the playground to take census.

Census: There were 2 Toddlers on the Toddler playground with one staff from rm. 4 the Monkeys room (the Toddlers room). There were 11 children on the Pre-school playground with one stafff on the Pre-school playground. Staff-child ratio was met. Both staff were cleared and associated.

opposite gender is done and because this is a disturbance to the entire class of children because their teacher has to stop what they are doing to supervise a child/children in the restroom. This
also poses a ratio issue because the teacher in the Butterflies (Parrots) classroom would have to attempt to supervise the children in their classroom while standing in the doorway trying to also supervise the children in the bathroom. (This holds true as well for the teacher in the Ladybugs room trying to supervise the children at the sinks.) Some staff were concerned because anyone walking into the Butterflies (Parrots) room could observe children in the restroom simply by looking into the mirror.

Ultimately, the allegation has been determined to be Substantiated because of what was written on the "Bathroom instructions" which were given to at least one set of parents and the staff. The instructions state, "The following are measures we have and will put into place at the Preschool to help with our bathroom situation." Then with bullet points are the following:
  • The teachers will now wait in the south-east corner while their classes are using the restrooms to supervise the toilet side, and have students line up on th east wall.
  • We are looking to install half stall doors, which the children can latch while they are inside the stall, so no one can enter at will. (We are getting quotes on this, as we do not have the old ones anymore.)
  • We will follow our normal procedure for the time beign sending children to the restroom in a male or female order, not mixing sexes. The teacher sending the child/ren will alert the teachers via walkie talkie in the rooms adjacent to the bathrooms.
  • We have hung a mirror on the toilet side of the bathroom facing the room adjacent to it, so the teacher can see into the stalls.
  • We will be having a "bathroom monitor" to [SIC] who will be assisting children to the restroom, if class is in session. .

next twelve (12) months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent. LPA provided Licensee with a completed copy of the LIC 9224 Acknowledgement of Receipt of Licensing Report.

Upon receipt, Executive Preschool Director Christi Navarrette posted the Notice of Site Visit. The Notice of Site Visit shall be posted for thirty (30) consecutive days. Failure to maintain posting as required will result in a $100 civil penalty.

Since June 2019, children are divided by gender and sent to the restroom and a teacher from the adjacent room is asked to supervise them while also watching their classroom. This poses an immediate risk to the health and safety of children in care.

  • While children are outdoors, we will bring children in to go to the restroom in male or female order, and a teacher will be in full sight of the child at all times.


Of the six items listed above, only three of them have been implemented. Though there may not have been incidents prior or after May or June 2019 such as the one which triggered these instructions to be written, ultimately, what has been put in place is not enough to guarantee supervision and violates ratio and potentially violates the Personal Rights of children, which means that it cannot be a method supported by Community Care Licensing.

Thus, based upon interviews conducted and LPA’s own observations, the preponderance of evidence standard has been met. Therefore, the allegation of "Neglect/Lack of Supervision: that Day care children are permitted to use the restroom unattended" has been found to be Substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, Article 06. Continuing Requirements, Section 101229 "Responsibility for Providing Care and Supervision" is being cited on the attached LIC 9099D.

The following is being cited in accordance to Title 22 of the California Code of Regulations. Please refer to 9099D for documentation of deficiencies.

Upon receipt, the Licensee shall post the Notice of Site Visit and this Licensing report. This report and the Notice of Site Visit shall be posted for thirty (30) consecutive days. Failure to maintain posting as required will result in a $100 civil penalty. A copy of this
report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the

Throughout the course of the investigation, interviews were conducted with eight staff, one adult and the Reporting Party. Documentation in the form of a list of “Bathroom instructions” was obtained and six photos of the “Preschool Restroom” were taken by LPA.

-Pertaining to the allegation that “Day care children are permitted to use the restroom unattended":

The allegation refers to the restroom in the middle of the hallway which is shared by five pre-school classrooms (all except the 2 year olds and the Toddlers). The bathroom is situated in such a way that the sinks are all on one side and the doorway from the Ladybugs classroom faces the row of sinks, while the bathroom stalls are all on the other side of a wall and the doorway from the Butterflies classroom faces the row of stalls. There are a total of three bathroom stalls. Each stall, though separated by walls, has a curtain which can be opened or closed for privacy.

Based upon interviews conducted, up until May or June, staff would send children from any of the five classrooms to the bathroom. In June of this year, staff were instructed in "Bathroom instructions" to begin sending only children of the same gender to the bathroom at the same time and to call down to the (then Parrots, now Butterflies) classroom and inform the teacher in the room that children were on their way down to the restroom. In addition, a mirror was installed in the corner of the restroom so that the stalls could be visually monitored by anyone who were to look in the mirror.

However, sending only children of the same gender to the restroom at the same time poses a potential Personal Rights issue because a child may be told to "wait" or "hold" until a child of the

The allegation refers to an incident which occurred in either May or June of 2019 when Child #1 and Child #2 were sent to the bathroom at the same time and Child #1 allegedly went into the stall of Child #2 and touched him/her on their private area.

Based upon interviews conducted, it is unclear whether Child #1 touched Child #2 on their private area or elsewhere or whether Child #1 exposed themself to Child #2. As LPA was unable to interview the children involved, and as there were no witnesses other than the children as to exactly what occurred in the stall, the allegation has been determined to be Unsubstantiated (formerly Inconclusive). A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.

This agency has investigated the complaint alleging that there was a violation of Title 22, Division 12, Chapter 1, Article 6, Section 101229 "Responsibility for Providing Care and Supervision" and Section 101223 "Personal Rights." The complaint alleged that "Facility failed to supervise day care children properly resulting in inappropriate touching between day care children.”Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated.
