THIS INSPECTION WAS CONDUCTED IN SPANISH
Licensing Program Analyst (LPA) Rita Ramos conducted an unannounced annual inspection to the above facility on 03/10/22. LPA arrived at the facility at 12:55 PM, identified self and met with Irma Rivas, Licensee, who guided analyst on a tour of the facility. LPA provided Licensee with a copy of the LIC 126 Entrance Checklist to help facilitate the inspection. LPA observed that also present during this inspection, was Licensee's husband (German Rivas), and Licensee's 2 daughter's (Kenia and Diana Rivas). LPA observed 6 children upon arrival. Per Licensee, operation hours are to 6AM to 5:59AM. There are 14 children that are currently enrolled. A current children’s roster was available for review.


This is a one-story home which consists of 3 bedrooms, 2 bathrooms, kitchen, dining room, living room, child care room, front yard and backyard. At approximately 1:02PM, LPA observed that there is construction in the back part of the house. Per Licensee, they are adding a den, a laundry room, and another restroom (pictures were taken). Licensee did not inform the department of their room addition to the home. Per Licensee, the home has been under construction for 7 months. The children use the bathroom located in the child care room. LPA further observed that there was a change in the room. A small wall that was in the child care room is no longer there. LPA Ramos had requested an updated facility sketch during a visit in 11/21/19 because the one prior to this date did not match. LPA is again requesting another updated sketch to reflect the new changes made. LPA observed that there is a fireplace in Licensee's bedroom that is barricaded. Per Licensee, areas off limits to children and parents include: all 3 bedrooms, 1 bathroom, and front yard. The licensee provides food for children in care.

Individuals who reside in the home were noted and discussed. Per Licensee, they currently have one assistant. ------Page 1 of 5

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated

There is a firearm in the home. LPA inspected the room and the location of storage. LPA observed that the firearm and ammunition are stored separately.

All areas for children to use were inspected for safety, comfort, and cleanliness. There is telephone service via a landline and cellphone that are used. There is ventilation and heating. Safe toys play equipment and materials were observed.

Detergents, cleaning compounds, medications, and other items which could pose a danger to children were observed to be inaccessible to children. Poisons are locked in the shed with a key lock. The restroom that children use was observed to be safe and sanitary.

At approximately 1:14PM LPA requested to see the fire extinguisher and Licensee did not have a fire extinguisher in the home. Per Licensee, they are outside because they have not been serviced. LPA then requested to see and test the smoke and carbon monoxide detectors. The smoke detector was tested to ensure that it is operable, however, the Licensee tested the carbon monoxide detector and it was not operable.

Licensee is currently caring for infants. Licensee states that infants sleep in the living room where they are constantly supervised. Appropriate sleeping arrangements and cribs were observed. Cribs or play yard did not hinder the entrance or exit from the sleeping space, mattresses shall be firm and covered with a fitted sheet that overlaps the underside so it cannot be dislodged. Cribs and play yards were observed to be free of loose articles and objects. No objects were observed to be hanging above or attached to the side of the crib. LPA did not observe any infants swaddled while in care. LPA was provided with a sleeping log and copies of the LIC 9227 for the infants in care. -----Page 2 of 5

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Due to Licensee operating from 6AM to 5:59AM, LPA discussed sleeping and napping arrangements for children in care. Per Licensee, there is always an adult awake and caring for any child that requires overnight care.



Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA did not observe any objects that can pose a danger to children on the outdoor yard. The licensee states that supervision is always provided.

The licensee is observed to be operating within the license capacity limitations. LPA did not observe any children left in parked vehicles. Car seats shall only be used for transportation. LPA observed 2 car seats in the home but they were not in use during the time of inspection and advised Licensee against sleeping infants in the car seats.

The licensee and other personnel have completed training on preventive health practices. However, at approximately 1:37PM LPA was provided with the only Pediatric First Aid and CPR cards Licensee had which expired 11//2019. LPA informed Licensee that the cards should have been renewed in November of 2019 and again November of 2021. There are first aid supplies available. LPA advised that if a child shows signs of illness he/she/they shall be separated from other children.

Children’s records were reviewed, including emergency information and were observed to be complete.

At approximately 1:39PM LPA observed that the Licensee and assistant do not have proof of the Mandated Reporter AB 1207 compliant Child Care Training Certificate on file.

All homes shall conduct fire and disaster drills at least once every six months, and document the date and time of each drill. Last drill documented was conducted on 02/15/22.



There is 2 dogs on the premises. Licensee places the dogs on a small dog run on the side of the home during hours of operation or when children are in care.

LPA did not observe any pools, spas, hot tubs, fish ponds, or similar bodies of water during the inspection.

Emergency Disaster Plan, Parent’s Rights Poster and the Facility License were observed to be posted.

LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, Trampolines and/or any other item that fall into these categories are not permitted in a family child care facility.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee/Director was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee/Director.


A notice of site visit was given and must remain posted for 30 days.
