Licensing Program Analyst (LPA) Warren Birks conducted an unannounced complaint inspection to deliver findings for the above allegation. LPA met with Director Jennifer Hollandsworth who provided information and assistance for the inspection.

Between 9:15am and 11:30am, LPA conducted interviews with staff #1, #2, #3 and the Director. LPA also reviewed a photo, a daily log and a June 27, 2023 Unusual Incident Report(UIR) submitted to Child Care Licensing. The UIR indicates that on June 23, 2023, staff #1 did not remove child #1's pull up after naptime (as per parent/facility verbal potty training agreement). As a result, child #1 was discovered later at home with a dried soiled pull up diaper. LPA received staff and Director disclosure that corroborates the incident report and the complaint.
Based on interviews, photos and incident report documentation, the preponderance of evidence standard has been met. therefore the above allegation is found to be SUBSTANTIATED. all the children and their diapering protocol. Therefore, the facility has color coded the whiteboard for children in diapers, and uses color coded postings for children who are potty training and already potty trained. The list also has directions to remove pull ups for napping potty trained children at 3:00pm daily (which is the approximate time that children who nap with pull ups wake up).

LPA did not receive any information indicating the non removal of the pull up (after nap time) incident is a systemic problem. LPA could not determine the exact amount of time the diaper was dry soiled. However, the incident is a potential risk to children in care.

LPA informed Director that the facility is cited for Title 22 Personal Rights (children are to be accorded safe healthful and comfortable accommodations).

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. This report along with a copy of the appeal rights was provided. Exit interview conducted with Director Hollandsworth.

evidenced by: Staff disclosure and June 26, 2023 incident report indicate the facility did not follow agreed potty training protocol on June 23, 2023. The preponderance of evidence indicates the incident resulted in child #1 having a dried soiled diaper discovered at home after pick up.

In addition staff now have their own list of children who they are responsible for which makes it more streamline. Director also indicated that beforehand, the Whiteboard list was harder to read and now the categories are much easier to read and follow.
