At 2:00pm Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced required 1-year inspection to the above facility. A COVID risk assessment was conducted upon entry and appropriate PPE was used. LPA met with Licensee, Sylvia Villarreal, to whom the reason for the visit was explained. Per Licensee, there are 4 children currently enrolled. There were 3 children and one adult (licensees’ husband) present upon arrival. The licensee was observed to be operating within the license capacity limitations.

The licensee states that 4 adults and no children currently live in the home. All adults living in the home have obtained a criminal record clearance.

This is a one-story home which consists of 3 bedrooms, 2 bathrooms, kitchen, dining room, living room, family room, detached garage, backyard with pool, and front yard.

Per licensee, areas off limits to children and parents include 3 bedrooms, one bathroom, garage, pool area, and front yard. The children have access to living room, dining room, family room, one bathroom, kitchen and backyard patio.

Licensee guided analyst on a tour of the facility at 2:10 pm. During this visit, all areas identified on the facility sketch that are accessible for children to use were toured and inspected and the following was observed.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Licensee will call the manufacturer of the pool fence and have the self-latching component repaired, so that it is self-latching. LPA will check with Licensing Program Manager to see if self-latching device location meets regulations and Licensee will fix gate to meet regualtions if needed.

Facility License, Emergency Disaster Plan, Parent’s Rights Poster, and Earthquake Preparedness Checklist were observed to be posted in the entry way of the home. A current children’s roster was available for review.

There is telephone service via a cellphone which stays at the facility during hours of operation. Hours of operation are Monday – Friday, 8:00 am – 5:30 pm. Per licensee, there is central air and heating in the home.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Per Licensee, poisons are located in the detached garage and locked with a key lock. LPA advised that any poisons should be locked under key or combination lock. Licensee states that there are no firearms or weapons stored in the home.

The valve on the required 2A 10BC fire extinguisher indicates fully charged and receipt shows a purchase date of 8/19/22. Smoke and carbon monoxide detectors were tested and are operable.

All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill documented was conducted on 7/11/22.

The home is observed to be clean and orderly. There are first aid supplies available. There are age-appropriate toys available for children. LPA observed a fireplace in the family room, which is screened making it inaccessible to children.

Licensee states that she is currently caring for 1 infant. LPA observed an LIC 9227 in the infant’s files, and LPA observed a sleep log for the infant.
LPA observed infant is currently sleeping on the floor on top of a rug and blanket and does not have a crib or play yard.

Currently, children are using the backyard for outdoor play time. Backyard contains a built-in swimming pool. The fence surrounding the pool is over 5 feet tall and the gate swings away from the pool and self closes. LPA and licensee observed the gate does not self-latch on this day, and that the self-latching device is more than 6 inches from the top of the gate. LPA also observed there is an alarm on the sliding glass good leading to the back yard patio and pool.

At 2:45 pm children’s records were reviewed, including emergency information and were observed to be complete.

At 3:10 pm Licensee records were reviewed. Licensee disclosed that her Pediatric First Aid and CPR is expired, and Mandated Reporter expires on 8/1/24. LPA observed licensee does not have proof of Preventative Health and Safety training. LPA observed that licensee is missing proof of Measles and Pertussis Immunizations and son and granddaughter living in the home do not have proof of TB test.


LPA issued an LIC 857, Children’s Record Review, and LIC 859, Staff Record Review to the licensee which documents staff and children’s files reviewed during this inspection.

Per licensee, there are 2 dogs on the premises and dogs are kept in the side yard during daycare hours.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, and/or any other item that fall into these categories are not permitted in a family child care facility.

LPA also informed licensees of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Based on the LPA’s observations and records reviews, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.
