On 07/12/2023 at 2:00 PM, Licensing Program Analyst (LPA)Katrina Chicote conducted an Unannounced Required – 1 Year inspection to the above facility. Upon arrival, LPA disclosed the purpose of the inspection and met with Licensee, Lamberta Espinoza, who granted entry and guide the LPA on a tour of the facility. Adults in the home were discussed and all have criminal record clearance. There were no day care children present during today’s inspection. Licensee states that she currently has no children enrolled. Facility is dual license as an RFA (#19R006504). LIC 126 was provided to Licensee upon entry. Emergency Disaster Plan, License, and Parents’ Rights were posted at the time of inspection. Disaster drill log was also available during today’s inspection, but no drill has been conducted in last six months due to no children enrolled.

This is a single-story home which consists of three bedrooms and two bathrooms, Kitchen, Living Room, and Dining Room. Areas used by the children include the Living Room (located upon entry of the home), Bedroom 1 (located across from Living Room), Dining Room (located to the rear of the home), and Bathroom 1 (located next to Dining Room). Per Licensee, areas off limits to children and parents include Kitchen and Bedrooms 2 and 3. LPA observed that there is an operable half door with a lock separating Kitchen and bedroom doors to have a high latch lock on each door making these areas off limits when children are in care.

All areas identified on the facility sketch as accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety of the children. There is a working telephone maintained in the home. At 2:02 PM, LPA observed Living Room to have sofa and tv hanging on corner of wall. LPA observed a treadmill in Living Room that Licensee states has multiple safety features in place. At 2:03 PM, LPA observed Bedroom 1 to have two twin beds and storage for toys available. Licensee states that children use this room for Overnight Care. LPA discussed overnight care procedures with Licensee at time of inspection and license limitations of not providing care for children longer than 23 hours at a time. At 2:06

PM, LPA observed Bathroom 1 to have operable toilet and sink, adequate supplies, and general area safety and sanitation. At 2:09 PM, LPA observed Dining Room, which Licensee states children will use for eating, to have rectangular dining table with six chairs and additional table and chairs for children eating. Licensee states she does provide food to children when in care. Detergents, cleaning compounds, medications, and other items which can pose a danger to children are inaccessible. LPA observed cleaning solutions in bathroom cabinet stored up high with operable child safety lock at time of inspection. The Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care.

Per Licensee, the children will have access to front yard for outdoor play. At 2:00 PM, LPA observed front yard has concrete through out with a corner designated play area that has plastic play structure with cushioning material below to absorb fall that is well maintained. LPA observed front yard has adequate perimeter fencing through-out the yard. LPA observed all trees, shrubs, and plants are maintained at time of inspection.

LPA observed two dogs, one large dog tied on front yard and another small dog in the home. Per Licensee, she has three dogs total that she keeps separate when daycare children are present. Per Licensee, there are no weapons, firearms in the home and there are no bodies of water around the premises. LPA observation did not see any bodies of water around the premises or firearms/weapons at time of inspection.

At 2:02 PM, LPA observed the valve on the required 2A 10BC fire extinguisher indicates fully charged with service tag dated 08/17/2022. LPA reminded Licensee to have fire extinguisher serviced by next month. At 2:12 PM, LPA tested smoke and carbon monoxide detectors and observed to be in operable condition at time of inspection. LPA observed First Aid kits available in Dining Room and Bedroom 1. The Licensee has current Pediatric First Aid and CPR valid until 11/27/2024. Proof of immunization against influenza, pertussis, and measles were readily available during today’s inspection. The Licensee has taken the Mandated Reporter Training on 01/12/2021. LPA discussed requirement to retake training every two years with Licensee at time of inspection.
—Children records and required licensing forms were discussed as well as mandated child abuse reporting and criminal record clearance requirement.

The following were discussed:
Incidental Medical Services (IMS) Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee (or facility representative) was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

AB 1207: Beginning on January 1, 2018, this law requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Mandatory Forms for the children’s files and staff files, requirements for fire drills, earthquake drills and documentation were discussed. Role and responsibilities of being a Mandated Reporter were reviewed. The Licensee was advised how to access forms and Regulations online at www.ccld.ca.gov. Licensee was made aware that it is his/her responsibility to know the regulations as well as anyone who assists in providing care.

Megan’s Law - Family Child Care Homes

The facility was found in compliance per Title 22 regulations, there will be no deficiencies cited today 07/12/2023.

A notice of site visit was given and must remain posted for 30 days.
