At 11:10 am Licensing Program Analysts (LPA) Roxana Lopez conducted an unannounced required 1 year inspection to the above facility. LPA met with Julie Sainz who led LPA to the day care room located in the the garage. Upon entering the day care room LPA observed high chairs, LPA consulted with Assistant that the garage can only be used for activity space not for eating or sleeping. This information was provided to Licensee upon arrival. At 11:20 am Licensee, Hiliana Sainz arrived at the facility and guided analysts on a tour of the facility. Also present during this inspection, was Christine Martinez, Licensee’s Assistant and Licensee's adult son. Per Licensee, there are 16 children that are currently enrolled. A current children’s roster was available for review. There were 9 children present upon arrival.

The licensee states that 4 adults. Per Licensee, she currently has two assistants. All adults present in the home have obtained a criminal record clearance or exemption prior to working, residing or volunteering in the licensed child care home. Licensee states that there are no firearms stored in the home.

This is a one-story home which consists of 3 bedrooms, 2 bathrooms, kitchen, dining room, 2 living rooms, garage (used as activity space), front yard and backyard (fenced). The children use the bathroom located next to the kitchen, living rooms used for napping, dining room area and backyard (fenced). LPA observed that there is a fireplace in one of the living rooms and it is barricaded. During the inspection of the main house LPA observed two play pens located in the bedrooms. Per Licensee, she uses the bedrooms to sleep infants. Per Licensee the areas off limits to children and parents include: 3 bedrooms (two use for napping only) and one bathroom. Around 11:35 AM LPA advise Licensee that if bedrooms were off limits she could not sleep the children in the bedrooms. Licensee, took out the playpens and placed them in the living room. During inspection Licensee placed a child safety gate to make bedrooms inaccessible. Per Licensee she would like to make all bedrooms inaccessible and will provide a new facility sketch.

The licensee provides food for children in care.

All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. There is telephone service via a landline. There is ventilation and heating (central). The following was observed and reviewed during this inspection.

Detergents, cleaning compounds, medications, and other items which could pose a danger to children were observed to be inaccessible to children. The licensee states that there are no poisons in the home and understands that storage areas for poisons must be locked with a key or combination lock. The restroom that children use was observed to be safe and sanitary.

At 12:10 pm Licensee, took out all high chairs from the garage and placed them in kitchen area where she proceeded to feed the children.

The valve on the required 2A 10BC fire extinguisher located in the kitchen indicates fully charged and was last serviced on 03/22/2019, as indicated on service tag. Smoke and carbon monoxide detectors were tested and are operable. All homes shall conduct fire and disaster drills at least once every six months, and document the date and time of each drill. Last drill documented was conducted on 02/26/2020.

Emergency Disaster Plan, Parent’s Rights Poster and the Facility License were observed to be posted on the parent board by the bathroom.

The home is observed to be clean and orderly. There are toys available for children. Appropriate sleeping arrangements in form of mats and play pens were observed.

Licensee states that she is currently caring for infants. LPA advised the licensee to sleep infants where they can always be directly supervised and advised the licensee against sleeping infants in a separate room.

During inspection Licensee moved the play pens and stated that infants will sleep in the living room, where they are constantly supervised.

LPAs did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, Trampolines and/or any other item that fall into these categories are not permitted in a family child care facility.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA did not observe any objects that can pose a danger to children on the outdoor yard. There are no pets on the premises.



The licensee is observed to be operating within the license capacity limitations.

At 12:45 PM children’s records were reviewed, including emergency information and were observed to be complete.

The licensee and other personnel have completed training on preventive health practices including Pediatric First Aid and CPR. Per Licensee, her daughter assists in the day care when is not in school. LPA advised for daughter to take AB 1207 Mandated Reporter complaint Child Care Training. The licensee's Pediatric First Aid and CPR expires on 05/24/2021.The Licensee's Assistant Pediatric First Aid and CPR expires on 2/22/2020. There are first aid supplies available.

LPA observed that the Licensee and assistant do have proof of immunization record. The Licensee Mandated Reporter AB 1207 compliant Child Care Training Certificate on file taken on 3/8/2020.

LPA issued a Confidential Names List (LIC 811) to the licensee which documents staff and children’s files reviewed during this inspection.



At 12:50 pm Licensee stepped out to pick up a child from school. Leaving her assistant and daughter in charge.

Incidental Medical Services (IMS):
LPA consulted with Licensee about IMS services. Per licensee, there are no children enrolled that require IMS at this time. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA advised the licensee to access forms, regulations and quarterly updates on line at: www.ccld.ca.gov.

The following was discussed with the Licensee:

Individuals who are 18 years of age or older living in the home must obtain a criminal record clearance. Individuals within one month of their 18th birthday must be fingerprinted immediately. Failure to obtain criminal record background check clearances prior to initial presence in the home will result in an immediate $100.00 dollar or more per day Civil Penalty.

In the absence of the Licensee, a qualified adult must be present supervising the children; a qualified adult is an individual who has a valid and current adult/infant CPR & Pediatric First Aid certification and a valid criminal record clearance associated to the facility license.

LPA provided the licensee with a copy of the Child Care Provider’s Guide to Safe Sleep, by American Academy of Pediatrics and Helping you to reduce the risk of SIDS. LPA also consulted and explained Never Shake a Baby pamphlet, Lead Exposure pamphlet, Capacity Handout (Small & Large) was provided during this inspection. and Safe Sleeping practices.



At this time, the licensee is in compliance with California Code of Regulations Title 22. No deficiencies cited.
