An unannounced inspection was conducted by Licensing Program Analyst (LPA) Roxana Lopez on 2/27/2023. A risk assessment was conducted appropriate PPE was used. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 1/17/2023. LPA met with Director Anahi Salinas to whom the purpose of the inspection was announced. Census was taken.

Throughout the course of the investigation, interviews were conducted with staff and parents. LPA also reviewed and obtained copies of children’s rosters, personnel reports, pictures and other documentation
.
An interview was conducted with the complainant to obtain further details regarding the allegations made. Per complainant, they have seen rats and rat feces throughout the entire facility and children are napping next to traps.
Regarding allegation # 1 children are napping next to rat traps, allegation # 2 there are rats in the facility

and allegation # 3 the facility has rat feces: LPA conducted interviews with the complainant and staff. Though the complainant mentioned that children sleep next to rat traps, there are rats and rat feces in the facility no disclosures were made by staff or children.

LPA conducted interviews with staff # 1- 6. All staff statements corroborated that they have seen traps in off-limits areas for the children. Per S1 and S6 the offices next door has a rodent problem and the building management placed traps in the day care facility for prevention. Staff # 1, 2,3 and 6 corroborated that all children in the infant room sleep in cribs. Additionally, Staff # 1-6 corroborated that they have not seen any rats inside or outside of the facility. Staff # 3 disclosed seeing rat feces under a sink once - Staff # 1,2,4,5 and 6 corroborated that they have not seen any rat feces.

During inspections, LPA observed traps in off-limit areas, hallway and kitchen areas. Traps were not accessible to children in care. LPA did not observe any children next to traps, rats and/or rat feces in the facility. Per Staff # 6 facility has been sanitized and traps have been removed.

LPA conducted interviews with parents. Parent’s statements corroborate that they do not have any concerns with the upkeep of the facility and have not seen anything dangerous in the facility.

This agency has investigated the complaint alleging, children are napping next to rat traps, there are rats in the facility and the facility has rat feces Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
