THIS INSPECTION WAS CONDUCTED IN SPANISH
On 07/13/2022, Licensing Program Analyst (LPA), Susann Sanchez conducted an unannounced complaint inspection for the purpose of delivering findings. LPA met with the Gisela Ibarra, who gave LPA a tour of the facility at 10:40am. There were 5 children, 2 infants, and 3 staff members present when LPA arrived.

During the course of the investigation, LPA Jeanette Estrada obtained pertinent documents and conducted interviews. No disclosures were made by the parties interviewed that corroborated the allegation.
LPA interviewed the Licensee who stated there are two assistants who work in the daycare. Staff 1 lives in the home with the Licensee and Staff 2 lives next door. Per the Licensee, children are not left alone and there is always someone present. Per the Licensee, it may occasionally occur that an errand needs to be completed during the day but if that is the case, they ensure that at least 2 of them (Licensee, staff 1 & Staff 2) are present with the children. Staff 1 stated there is always one of them present with the children. Staff 2 stated the children are not left alone.

LPA reviewed staff files for Staff 1 and Staff 2. Staff 1 and Staff 2 have current Pediatric First Aid and CPR certification which expires on 5/22/23 and current Mandated Reporter Certification completed on 1/2/2022, they are have obtained criminal record clearances and have been participating in the day care for 16 to 20 years. Parent interviews also revealed that children have not been left unattended as there is always someone present when they arrive at the facility. The Licensee, Staff 1 and Staff 2 stated they understand that if there are more than 8 children present, more than one staff must also be present.

Although the Licensee stated she may leave the day care on occasion, it cannot be confirmed that children have been left unattended for an extended period of time, therefore the allegation is unsubstantiated. Unsubstantiated – A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit made by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Ibarra Licensee. A copy of this report along with Appeal Rights were provided to the Licensee. Appeal Rights were given in Spanish and were explained.
