32 | Allegation #1: Staff do not provide adequate supervision to children in care
According to the allegation, staff are not able to visually supervise the entire classroom while standing at the changing table. LPA observed the changing table is in the room behind the main classroom area, in the same area as the children’s restroom.
LPA observed a 48 inch by 43 inch cut-out in the wall between the main classroom and the changing table area, and staff must exit the main classroom’s half door and turn right to enter the room with the changing table.
LPA observed that the staff cannot see the entire classroom when they are changing children at the changing table, as there are several blind spots where children in the classroom cannot be visually supervised by the staff standing next to the changing table. This information was confirmed during staff interviews.
Staff #3 (S3), Staff #5 (S5), Staff #6 (S6), and Staff #7 (S7) stated they are unable to visually supervise all children in the classroom when they are the only staff in the room, and they are changing a child’s diaper. S5 stated, “If the child is sitting down or in the corner, it is a blind spot. I can only see what I can see through that opening”. S6 stated, “If I am by myself, I leave the door open so the kids can get to me. The wall blocks my view, so I constantly must be looking to see if the kids are safe”. When LPA asked if S6 was able to visually supervise all the children while changing a diaper, S6 stated, “I did the best I could, but no, not with the wall there”. S3 and S7 stated they bring the other children in care into the corridor on the other side of the ½ door, where the refrigerator is located when they change a diaper and are the only staff present.
LPA observed that staff would still not be able to supervise children in the corridor as staff would have to look around the doorjamb, next to the wall, behind the changing table to see the children in the corridor. S3 and S7 disclosed that they still cannot provide proper supervision when bringing children into the corridor. S7 stated, “Ya, that wall messes it up”.
Based on LPAs observations, and interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12, Chapter 1), are being cited on the attached LIC 9099D.
