Licensing Program Analyst (LPA) Cynthia Reyes contacted the facility via telephone to initiate the follow up complaint investigation due to COVID-19 and pre-cautionary measures. LPA Reyes identified herself and discussed the purpose of the call. Per phone conversation with Ms. Leula, there are no staff or children currently present at the facility except her daughter Dishani, in case any parent request care for their child. Director states since no children have attended she may close completely for precautionary measures due to Covid-19 on Monday the 13th.

During the course of the investigation, interviews were conducted with staff, parents and complainant. LPA also reviewed and obtained copies of the children ID and Emergency Information form and staff personal report. Although the allegation may have happened or is valid there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. There were no disclosures made of staff pinched or yelled at day care children while in care from any one interviewed except the complanant.

LPA interviewed all staff except one who was not available to be interviewed. All staff that were interviewed stated they had not witnessed any staff member yelling or pinching any child. All staff also stated they them self have not yelled or pinched any child. One staff stated, when we tell a group of kids we are loud but not yelling directly at the kids.

An exit telephone interview was conducted with Nilani Leula as well as appeal rights were explained. A copy of this report was signed by LPA Reyes. This report along with the appeal rights will be sent via email to Nilani Leula who agrees to sign and date each page of the report. Ms. Leula understands that an electronic “Read Receipt” and/or confirmation of receipt of the e-mail confirms receipt of the report and constitutes an electronic signature. The facility representative was provided with the mailing address for the Monterey Park Regional office, if she would like to drop the report off and/or she agrees to send the original report by mail.

Director was verbally informed of why, No Notice of site visit was given as no physical inspection was conducted to present the findings due to COVID-19 and pre-cautionary measures.
