Information from complainant indicates that staff at the facility had pulled a child’s hair and that staff #2 and #5 were punishing children in the restroom with the door closed.
Director states that the incident that took place on 02/22/2022 was internally investigated. A child was crying and emotional at the facility and hit a staff member. Staff #2 brought the child into the office to assist, calming the child down. The child continued to cry and wet their pants. Staff #2 took them to the restroom to allow them to finish using the restroom. While child was washing their hands, Staff #2 asked Staff #5 to bring the child’s extra pair of pants so they could change in the restroom. Per Director, Staff #2 was still visually supervising the child when speaking to Staff #5 for the pants. LPA observed that the door to the sinks of the restroom is only a half door and that the doorway to the actual toilets does not have a door on the hinges to allow staff supervision when children are using the restroom. Director provided a copy of the investigation report that they, Staff #2, and Staff #5 signed. In regards to discipline, director states that they speak with the children when they do not listen. They will sometimes use time-out for as many minutes as the child’s age is. Director made no disclosures of children being handled in a rough manner or inappropriately.
During Staff interviews, Staff #2 corroborated the incident that took place on 02/22/2022. Staff #2 stated Staff #5 did not assist with changing the child’s pants in the restroom. Staff #5 had to stay with the class and only provided the clean pair of pants. Staff #3 and #4 corroborated that time-outs are used for discipline for as many minutes as the child’s age. Staff made no disclosures regarding the allegations.

Parents interviewed made no disclosures regarding the allegations.
Based upon the evidence as presented above, this agency has investigated the allegation above and has determined that the allegation is Unsubstantiated. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is unsubstantiated.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 day during the hours of operation after each site visit by a licensing representative.
