On 9/14/22 Licensing Program Analyst (LPA) Jeanette Estrada conducted an unannounced required 1 year inspection at the above facility. LPA arrived at the facility at approximately 12:49 PM. There was no one at the facility when LPA arrived. LPA spoke to Licensee via phone. Licensee informed LPA she was picking up children and would be home in a few minutes. Licensee arrived at approximately 1:18PM. LPA met with the Licensee Mariana Sinohui and informed her of the purpose for the visit. Licensee guided LPA on a tour of the facility. There were 4 children present when LPA arrived. All residents were noted and verified. Per Licensee, her adult son, David Sinohui lives in the home. LPA verified with the associations list, that David Sinohui does not have a criminal record clearance. Per Licensee, David Sinohui has not attempted to obtain a criminal record clearance for the day care. David Sinohui was not present during the inspection.
Care is provided to children ages 6 weeks to 13 years old and operation days/ hours are Monday through Friday 6AM to 5 PM
This is a one story, 3 bedroom, 2 bathroom home, with a living room, kitchen, fenced front yard, fenced backyard and garage.
Per Licensee areas on limits to children are: Living room, bathroom in hallway, kitchen, fenced front yard.
Per Licensee areas off limits to children are: 3 bedrooms, one bathroom in a bedroom, backyard and garage.
All areas that are accessible to children were inspected for safety, comfort, and cleanliness. The following was observed and reviewed during this inspection: LPA observed required posted documentation- Facility license, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form. LPA observed and reviewed a current roster LIC 9040. There was no disaster drill log available at the facility. Per Licensee the last disaster drill was conducted a few months ago. There is an operable smoke detector in the facility. Per Licensee, the detector also detects carbon monoxide. LPA could not verify that the detector was also used for Carbon Monoxide. There were no other Carbon Monoxide detectors in the facility. LPA observed a Fire Extinguisher in the kitchen which indicated full and was last serviced October 2021.

The home maintains telephone service (cell phone). Food is provided by Licensee. Licensee was reminded if children bring food from home it must be labeled with the child’s name and properly stored or refrigerated.
There are toys and other age appropriate materials available for children to use in the living room. Sharp objects, detergents and cleaning compounds were inaccessible to children in care. Knives are kept inaccessible to children above the kitchen cabinets, cleaning supplies are kept in an upper cabinet in the hallway, detergents are kept in the off limits garage.
LPA observed personal medication is stored in an upper kitchen cabinet . Per Licensee, no children enrolled require medication. The facility has central air and heating. There were no fireplaces observed. Children nap in the living room and they are provided appropriate napping equipment. Children use the restroom in the hallway. LPA inspected cabinets in the restroom where hygiene items are stored.
Children use the front yard for outdoor play. LPA observed the front yard is fully fenced. Per Licensee, children are supervised while playing outside. Per Licensee, there are no poisons in the home. Licensee understands that all poisons must be locked, not only inaccessible to children. Isolation area for sick children waiting to be picked up is in a section of the living room, separated from other children. There are weapons in the home. LPA observed the weapons to be in an off limits room, inaccessible to children. Firearms are stored separately from ammunition in separate locked containers. LPA did not observe any pools or spas, or other bodies of water. There are 5 pet dogs in the home. Per Licensee, dogs are up to date on vaccinations.
Infant Care: Currently licensee has 1 infant enrolled. Per Licensee, there are no infants under 12 months enrolled. LPA observed a play yard in the living room. LPA did not observe any blankets or pillows in the play yard. Licensee was advised Infants shall not be swaddled in care. Car seats shall not be used for sleeping. LPAs discussed the new Safe sleep regulation, including LIC 9227 Infant Sleep Plan for infants under 12 months, 15-minute sleep check documentation for infants 0-24 months.
Overnight Care: There is no overnight care provided at the moment. LPA discussed the following: Licensee is aware that they must remain awake while children are awake. If children sleep in separate area from licensee, the door must remain open. If licensee cannot hear children when they wake up, video or audio device can be used.
Children's records were reviewed: Children's records contained LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, Infant sleep log. 2 out of 4 children did not have LIC 995A Notification of Parents’ Rights on file, 1 out of 4 children did not have proof of immunizations on file.

Staff records were reviewed: Licensee's pediatric CPR/First Aid was completed on 3/15/21, Licensee had proof of immunization of pertussis but not measles. Licensee has a flu declination on file. Licensee has not completed Mandated reporter training. Licensee was advised mandated reporter training is required to be completed every two years. During inspection the children present were observed to be treated with dignity and respect, and free from corporal and/or unusual punishment.
Incidental Medical Services (IMS): Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a plan for providing IMS must be submitted to the Department. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
A $500 civil penalty is being issued today for Licensee's adult son, David Sinohui who resides in the home and has not received a criminal record clearance since turning 18 in 2021.
LPA discussed the safe sleep regulations with Licensee and discussed the Child Care Licensing Safe Sleep webpage athttps://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleephttps://www.cdss.ca.gov/inforesources/child-care-licensing/ public -information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. The deficiencies listed on the following pages were observed by the LPA and are being cited in accordance with California Code of Regulations Title 22. One type A citation was issued today for CCR 102370(d)(1) Criminal Record Clearance . Please see attached LIC 809-Ds for citations.
Deficiencies that are being cited need to be cleared to protect the children’s health & safety.

The notice of site visit shall be posted where the parent/guardian of children enter and exit the facility.
A copy of this report shall also be posted where the parent/guardian of children enter and exit the facility.
Both the notice of site visit and licensing report shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.
A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon their return.
A copy of this report shall also be provided to the parent/guardian of any newly enrolled child for the next 12 months. A signed Acknowledgement of Receipt (LIC9224) shall be in each child’s file, acknowledging receipt.

Exit interview conducted and report was reviewed with the Licensee, Mariana Sinohui. A notice of site visit was given and must remain posted for 30 days.
